Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Economic Development was held on Monday, April 27, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 2:41 p.m.  There being a quorum present, the following business was transacted: 

 

The following members arrived after the roll was called:  Senator Zaffirini 

 

The chair laid out SB 542 and recognized the author, Senator Watson, to explain the bill.

 

Witnesses registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris moved that SB 542 be left pending; without objection, it was so ordered.  

 

Senator Deuell assumed the chair.  The roll was called and a quorum was established.

 

The chair laid out HB 752 in lieu of SB 2174 and recognized the Senate sponsor, Senator Harris, to explain the bill.

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris moved that HB 752 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Eltife assumed the chair. 

 

The chair laid out SB 2173 and recognized the author, Senator Harris, to explain the bill.

Senator Harris moved that SB 2173 be left pending; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 885 and recognized the author, Senator Harris, to explain the bill. 

 

Senator Harris moved that SB 885 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Harris resumed the chair. 

 

The chair laid out SB 108 and recognized Senator Watson, in the absence of the author, to explain the bill. 

 

Senator Watson sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered.

Senator Watson moved that SB 108 do not pass but that CSSB 108 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The chair laid out SB 2496 and recognized the author, Senator Patrick, to explain the bill. 

 

Senator Harris sent up Committee Amendment 1 and Committee Amendment 2 and moved adoption; without objection, the amendments were adopted.

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Eltife moved that SB 2496 do not pass but that CSSB 2496 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Eltife moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 1637 and recognized Senator Watson, in the absence of the Senate sponsor, to explain the bill.

Senator Watson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1429 and recognized Senator Eltife, in the absence of the author, to explain the bill. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

 

 

Senator Eltife sent up a committee substitute; the chair recognized Senator Eltife to explain the difference between the committee substitute and the senate bill as filed.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Eltife moved that SB 1429 do not pass but that CSSB 1429 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The following motion in writing was received from the following Committee member. Senator Zaffirini requested to be shown voting aye on the following Senate bills, 885 and 1429 and the following House bills, 752 and 1637.

 

There being no further business, at 3:21 p.m. Senator Harris moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
