Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Agriculture & Rural Affairs was held on Tuesday, April 28, 2009, at Senator Estes's Desk.

The chair called the meeting to order at 2:55 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business SB 1871.  Senator Hegar sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the senate bill as filed.  Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered.  Senator Hegar moved that SB 1871 do not pass but that CSSB 1871 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 1684.  Senator Jackson sent up a committee substitute; the chair recognized Senator Jackson to explain the difference between the committee substitute and the house bill as engrossed.  Senator Jackson moved adoption of the committee substitute; without objection, it was so ordered. Senator Jackson moved that HB 1684 do not pass but that CSHB 1684 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 2333.  The chair sent up a committee substitute and explained the difference between the committee substitute and the senate bill as filed.  Senator Uresti moved adoption of the committee substitute; without objection, it was so ordered.  Senator Uresti moved that SB 2333 do not pass but that CSSB 2333 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Uresti moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 1908.  Senator Hinojosa sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.   

Senator Hinojosa requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Hinojosa then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Hinojosa moved that HB 1908 do not pass but that CSHB 1908 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 865 in lieu of pending SB 691.  Senator Hegar sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Hegar requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Hegar then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Hegar moved that HB 865 do not pass but that CSHB 865 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Jackson moved that HB 328 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 2527.  Senator Hegar moved that HB 2527 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 2042 in lieu of pending SB 1851.  Senator Hinojosa moved that HB 2042 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1088.  Senator Jackson moved that SB 1088 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

The chair laid out as a matter of pending business SB 1668.  Senator Hinojosa moved that SB 1668 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 3 ayes, 1 nay, 0 present not voting, and 1 absent.
