Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Agriculture & Rural Affairs was held on Monday, April 6, 2009, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 3:22 p.m.  The following business was transacted: 

 

The chair laid out SB 212 and recognized the author, Senator Shapleigh, to explain the bill. The chair sent up a committee substitute; the chair recognized Senator Shapleigh to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved to withdraw the committee substitute. There being no objection, it was so ordered. The chair moved that SB 212 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1666 and explained the bill.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 3:33 pm Senator Jackson assumed the chair.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that SB 1666 be left pending; without objection, it was so ordered. 

 

At 3:35 pm Senator Estes resumed the chair.

 

 

The chair laid out SB 2379 and recognized the author, Senator Jackson, to explain the bill. The chair sent up a committee substitute; the chair recognized Senator Jackson to explain the difference between the committee substitute and the senate bill as filed.  The chair moved to withdraw the committee substitute; without objection, it was so ordered. The chair moved that SB 2379 be temporarily left pending; without objection, it was so ordered.  

 

The clerk called the roll and a quorum was established at 3:40 pm.

 

The chair laid out as a matter of pending business SB 1163 and, in the absence of the author, explained the bill.  Senator Hegar sent up a committee substitute and moved adoption of the committee substitute; without objection, it was so ordered.  Senator Hegar moved that SB 1163 do not pass but that CSSB 1163 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 3 ayes, 1 nay, 0 present not voting, and 1 absent. 

 

At 3:41 pm Senator Jackson assumed the chair.

 

The chair laid out as a matter of pending business SB 1988.  Senator Hegar moved that SB 1988 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 3:42 pm Senator Estes resumed the chair.

 

The chair laid out as a matter of pending business SB 2379.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Estes moved that SB 2379 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1693 and recognized the author, Senator Ogden, to explain the bill. The chair sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Hegar moved to withdraw the committee substitute; without objection, it was so ordered. The chair moved that SB 1693 be left pending; without objection, it was so ordered.

Senator Uresti submitted a motion in writing requesting to be shown that he vote aye on SB 1988 and that he vote nay on CSSB 1163.

 

Senator Hinojosa submitted a motion in writing requesting to be shown that he vote aye on SB 1988.
