Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Agriculture & Rural Affairs was held on Monday, March 23, 2009, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 4:01 p.m.  The following business was transacted: 

 

The chair laid out SB 205 and recognized the author, Senator Shapleigh, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that SB 205 be left pending; without objection, it was so ordered. 

 

The following members arrived after the roll was called:  Senator Uresti.

 

The chair laid out SB 1027 and recognized the author, Senator Watson, to explain the bill.  Senator Uresti sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved to withdraw the committee substitute.  There being no objection, it was so ordered.  The chair moved that SB 1027 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 399 and recognized the author, Senator Seliger, to explain the bill.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that SB 399 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 969 and recognized the author, Senator Seliger, to explain the bill.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that SB 969 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1163 and recognized the author, Senator Seliger, to explain the bill.  Senator Uresti sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved to withdraw the committee substitute.  There being no objection, it was so ordered.  The chair moved that SB 1163 be left pending; without objection, it was so ordered. 

 

The following members arrived after the roll was called:  Senator Jackson.  A quorum was established at 5:13 p.m. 

 

At 5:16 p.m. Senator Uresti assumed the chair. 

 

The chair laid out as a matter of pending business SB 948 and recognized the author, Senator Estes, to explain the bill.  Senator Jackson moved that SB 948 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 5:18 p.m. Senator Estes resumed the chair. 

 

The chair laid out as a matter of pending business CSSB 344 and, in the absence of the author, explained the committee substitute.  Senator Uresti moved that SB 344 do not pass but that CSSB 344 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Uresti moved that the committee substitute be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Jackson laid out as a matter of pending business CSSB 768 and recognized the chair, in the absence of the author, to explain the committee substitute.  Senator Jackson moved that SB 768 do not pass but that CSSB 768 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 1059 and recognized Senator Uresti, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The following members arrived after the roll was called:  Senator Hegar.  Senator Hegar sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the senate bill as filed.  The chair moved to withdraw the committee substitute.  There being no objection, it was so ordered. The chair moved that SB 1059 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 682 and recognized the author, Senator Eltife, to explain the bill.  The following members arrived after the roll was called:  Senator Hinojosa.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that SB 682 be left pending; without objection, it was so ordered. 

 

The chair announced that Senator Hinojosa submitted a motion in writing requesting to be shown that he vote aye on the following committee substitutes and bill: CSSB 344, CSSB 768 and SB 948.

 

At 6:31 p.m. the chair moved that the committee stand recessed until subject to the call of the chair; without objection, it was so ordered.
