Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Administration was held on Tuesday, April 14, 2009, in the E1.714.

The chair called the meeting to order at 3:02 p.m.  There being a quorum present, the following business was transacted: 

 

There was no action taken for the following bill(s): SB 1746, SB 2307

 

The chair laid out as a matter of pending business SB 1540.  Senator Williams moved that SB 1540 be left pending until later in the hearing; without objection, it was so ordered. 

 

The following members arrived after the roll was called:  Senator Ogden, Senator Shapiro

 

The chair laid out SB 495 and recognized Senator Zaffirini, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Zaffirini moved that SB 495 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1756.  Senator Zaffirini moved to reconsider the vote by which Committee Amendment 1 was adopted at last week's hearing; without objection, it was so ordered. Committee Amendment 1 was left pending.  Senator Zaffirini sent up Committee Amendment 2.  Senator Williams explained Committee Amendment 2.  Pam Moore, representing Texas Legislative Council, testified on the bill.  Senator Williams moved that SB 1756 and Committee Amendment 2 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1969 and recognized the author, Senator West, to explain the bill.  Senator Wentworth sent up Committee Amendment 1. Senator West was recognized to explain Committee Amendment 1.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Zaffirini moved adoption; without objection, the amendment was adopted. 

 

Senator Zaffirini requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Zaffirini moved that SB 1969 do not pass but that CSSB 1969 be reported back to the Senate with the recommendation that it do pass and be printed.  Senator Zaffirini moved to reconsider the motion to roll the amendment into a committee substitute and adoption; without objection, it was so ordered.

 

Senator Zaffirini moved that SB 1969, as amended, be reported back to the Senate with the recommendation that it do pass and not be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   

 

The chair laid out as a matter of pending business SB 1540.  Senator Uresti moved that SB 1540 be reported favorably to the Senate with the recommendation that it do pass and not be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 1 present not voting, and 0 absent.  Senator Uresti moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 2071.  Senator Uresti moved that SB 2071 be reported favorably to the Senate with the recommendation that it do pass and not be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Uresti moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SCR 12 and recognized Senator Uresti, in the absence of the author, to explain the bill.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Williams moved that SCR 12 be left pending; without objection, it was so ordered.   

 

The chair laid out the list of bills recommended for placement on the Local and Uncontested Calendar to be held April 16, 2009, at 8:00 AM. The following bills were removed from the list: SB 54, SB 116, SB 249, SB 281, SB 390, SB 1070, SB 1071, SB 1127, SB 1130, SB 1255, SB 1414, SB 1450, SB 1606, SB 1743, SB 1848, SB 1862 and SB 1976.  Senator Uresti moved that, with the exception of the bills previously listed, the bills on the recommended list be certified for placement on the Local and Uncontested Calendar. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Whitmire submitted a Motion in Writing requesting unanimous consent to be shown voting aye on the following bills: SB 495, SB 1540, SB 1969 and SB 2071. Without objection, it was so ordered.

 

There being no further business, at 4:21 p.m. Senator Williams moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
