A BILL TO BE ENTITLED
 
AN ACT
  relating to the abolition of existing school districts in certain
  counties and the creation of new school districts.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter E, Chapter 13, Education Code, is
  amended by adding Section 13.206 to read as follows:
         Sec. 13.206.  ABOLITION OF EXISTING DISTRICTS IN CERTAIN
  COUNTIES; CREATION OF NEW DISTRICTS. (a) This section applies only
  to a school district that:
               (1)  is located in a county with a population of more
  than two million that is adjacent to a county with a population of
  more than one million; and
               (2)  has a student enrollment of more than 150,000.
         (b)  A school district to which this section applies shall be
  abolished and two or more districts shall be created from the
  territory of the district.
         (c)  An election is not required for the abolition or
  creation of a school district under this section.
         (d)  The commissioner shall adopt rules to implement this
  section.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
