A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the abolition of existing school districts in certain |
|
counties and the creation of new school districts. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter E, Chapter 13, Education Code, is |
|
amended by adding Section 13.206 to read as follows: |
|
Sec. 13.206. ABOLITION OF EXISTING DISTRICTS IN CERTAIN |
|
COUNTIES; CREATION OF NEW DISTRICTS. (a) This section applies only |
|
to a school district that: |
|
(1) is located in a county with a population of more |
|
than two million that is adjacent to a county with a population of |
|
more than one million; and |
|
(2) has a student enrollment of more than 150,000. |
|
(b) A school district to which this section applies shall be |
|
abolished and two or more districts shall be created from the |
|
territory of the district. |
|
(c) An election is not required for the abolition or |
|
creation of a school district under this section. |
|
(d) The commissioner shall adopt rules to implement this |
|
section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
