AN ACT
  relating to an interlocal contract for a relief highway route
  around certain municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 791, Government Code, is
  amended by adding Section 791.034 to read as follows:
         Sec. 791.034.  INTERLOCAL CONTRACT FOR RELIEF HIGHWAY ROUTE
  AROUND CERTAIN MUNICIPALITIES. (a)  The governing body of a
  municipality located in a county in which is located a facility
  licensed to dispose of low-level radioactive waste under Chapter
  401, Health and Safety Code, may enter into an interlocal contract
  with the county for the construction and maintenance of a relief
  highway route around and outside the boundaries of the municipality
  that the governing body determines will serve a public purpose of
  the municipality.
         (b)  The municipality may expend municipal funds and may
  issue certificates of obligation or bonds to pay for expenses
  associated with a relief highway route under Subsection (a).
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
