AN ACT
|
|
|
relating to an interlocal contract for a relief highway route |
|
|
around certain municipalities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 791, Government Code, is |
|
|
amended by adding Section 791.034 to read as follows: |
|
|
Sec. 791.034. INTERLOCAL CONTRACT FOR RELIEF HIGHWAY ROUTE |
|
|
AROUND CERTAIN MUNICIPALITIES. (a) The governing body of a |
|
|
municipality located in a county in which is located a facility |
|
|
licensed to dispose of low-level radioactive waste under Chapter |
|
|
401, Health and Safety Code, may enter into an interlocal contract |
|
|
with the county for the construction and maintenance of a relief |
|
|
highway route around and outside the boundaries of the municipality |
|
|
that the governing body determines will serve a public purpose of |
|
|
the municipality. |
|
|
(b) The municipality may expend municipal funds and may |
|
|
issue certificates of obligation or bonds to pay for expenses |
|
|
associated with a relief highway route under Subsection (a). |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
