A BILL TO BE ENTITLED
 
AN ACT
  relating to determining population for the creation of civil
  service systems in certain counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 158.002, Local Government Code, is
  amended to read as follows:
         Sec. 158.002.  ELIGIBLE COUNTIES. (a)  A county with a
  population of 190,000 or more may, in accordance with this
  subchapter, create a county civil service system to include all the
  employees of the county who are not exempted from the system by the
  express terms or judicial interpretations of this subchapter or by
  the operation of Subchapter B.
         (b)  The population of a county under this subchapter is
  determined by the most recent:
               (1)  federal decennial census; or
               (2)  annual population estimate provided by the state
  demographer under Chapter 468, Government Code, if that estimate is
  more recent than the most recent federal decennial census.
         (c)  The application of this subchapter to the county is not
  affected if the county's population changes and the county no
  longer meets the population requirement of Subsection (a).
         SECTION 2.  Section 158.032, Local Government Code, is
  amended to read as follows:
         Sec. 158.032.  ELIGIBLE DEPARTMENTS.  (a) A sheriff's
  department in a county with a population of more than 500,000 may,
  in accordance with this subchapter, create a civil service system.
         (b)  The population of a county under this subchapter is
  determined in the manner prescribed by Section 158.002(b).
         (c)  The application of this subchapter to the county is not
  affected if the county's population changes and the county no
  longer meets the population requirement of Subsection (a).
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
