A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to determining population for the creation of civil |
|
service systems in certain counties. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 158.002, Local Government Code, is |
|
amended to read as follows: |
|
Sec. 158.002. ELIGIBLE COUNTIES. (a) A county with a |
|
population of 190,000 or more may, in accordance with this |
|
subchapter, create a county civil service system to include all the |
|
employees of the county who are not exempted from the system by the |
|
express terms or judicial interpretations of this subchapter or by |
|
the operation of Subchapter B. |
|
(b) The population of a county under this subchapter is |
|
determined by the most recent: |
|
(1) federal decennial census; or |
|
(2) annual population estimate provided by the state |
|
demographer under Chapter 468, Government Code, if that estimate is |
|
more recent than the most recent federal decennial census. |
|
(c) The application of this subchapter to the county is not |
|
affected if the county's population changes and the county no |
|
longer meets the population requirement of Subsection (a). |

SECTION 2. Section 158.032, Local Government Code, is |
|
amended to read as follows: |
|
Sec. 158.032. ELIGIBLE DEPARTMENTS. (a) A sheriff's |
|
department in a county with a population of more than 500,000 may, |
|
in accordance with this subchapter, create a civil service system. |
|
(b) The population of a county under this subchapter is |
|
determined in the manner prescribed by Section 158.002(b). |
|
(c) The application of this subchapter to the county is not |
|
affected if the county's population changes and the county no |
|
longer meets the population requirement of Subsection (a). |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
