Amend CSHB 300 (House committee printing) by adding the
following appropriately numbered ARTICLE to the bill and
renumbering subsequent ARTICLES of the bill accordingly:
ARTICLE ____. SAFE ROUTES TO SCHOOL
SECTION ____.01. Subchapter A, Chapter 38, Education Code,
is amended by adding Section 38.025 to read as follows:
Sec. 38.025. SAFE ROUTES TO SCHOOL NON-INFRASTRUCTURE
PROGRAM. (a) The agency shall establish a safe routes to school
non-infrastructure program that promotes bicycling and pedestrian
safety and education for elementary and middle school students
through:
(1) education and awareness programs; and
(2) training, workshops, and educational materials.
(b) To the extent allowed by federal law, to implement this
section the agency may use not more than 30 percent of the funds
allocated to the state under the federal safe routes to school
program (Pub. L. No. 109-59, reprinted in note, 23 U.S.C. Section
402).
(c) To implement a program established under this section,
the agency shall contract with a statewide nonprofit organization
that has the primary purpose of promoting:
(1) bicycle safety and education; or
(2) pedestrian safety and education.
(d) Not more than five percent of the funds allocated to the
agency under this section may be used by the agency to administer
the safe routes to school non-infrastructure program.
(e) The commissioner shall adopt rules to implement this
section.
