	Amend CSHB 300 by inserting in the appropriate ARTICLE the 
following appropriately-numbered SECTION and renumbering any 
subsequent SECTIONS accordingly:
	SECTION ____.  Chapter 391, Transportation Code, is amended 
by adding Section 391.2521 to read as follows:
	Sec. 391.2521.  ERECTING OUTDOOR ADVERTISING FOR SEXUALLY 
ORIENTED BUSINESS WITHOUT PERMIT.  (a)  A person may not, without 
first obtaining a permit from the commission, erect or maintain 
outdoor advertising that advertises a sexually-oriented business 
that is adjacent to or visible from:
		(1)  Interstate 35 between the department's information 
center in Gainesville and the Texas-Oklahoma border; and
		(2)  U.S. Highways 69 and 75 between the department's 
information center in Denison and the Texas-Oklahoma border;
	(b)  The department shall issue a permit to a person under 
this section only if the person can show that the advertising:
		(1)  does not endanger the health, safety, welfare, 
morals, convenience, and enjoyment of the traveling public and the 
protection of the public investment in the interstate and primary 
highways systems and in travel information centers; and
		(2)  is not a public nuisance.                                         
	(c)  The department shall adopt rules to administer this 
section, including permit fees, forms, and application process.
	(d)  As used in this section, "sexually oriented business" 
has the meaning assigned by Section 243.002, Local Government Code.
