Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Transportation and Homeland Security was held on Wednesday, April 25, 2007, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 7:30 a.m.  There not being a quorum present, the following business was transacted: 

 

The chair laid out SCR 40 and recognized the author, Senator Estes, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The chair moved that SCR 40 be left pending; without objection, it was so ordered. 

 

The roll was called.  A quorum was established.

 

The chair laid out SB 154 and recognized Senator Shapleigh to explain the bill in the absence of the author, Senator Wentworth. 

 

Senator Shapleigh sent up a committee substitute; the chair recognized Senator Shapleigh to explain the difference between the committee substitute and the senate bill as filed. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The substitute was withdrawn without objection.

 

The chair moved that SB 154 be left pending; without objection, it was so ordered. 

 

The chair laid out HCR 173 and recognized the Senate sponsor, Senator Wentworth, to explain the bill. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The chair moved that HCR 173 be left pending; without objection, it was so ordered. 

 

At 8:11 a.m. Senator Watson assumed the chair. 

 

The chair laid out CSSB 1929 as pending business and recognized the author, Senator Carona, to explain the bill. 

 

Senator Carona moved that the committee reconsider the vote by which the substitute to the bill was previously adopted; without objection, it was so ordered.

 

Senator Carona sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed.  Senator Carona moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Carona sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Nichols moved that the committee reconsider the vote by which Amendment 1 was adopted; without objection, it was so ordered.

 

Senator Nichols sent up an amendment to Amendment one, and moved adoption; without objection, it was so ordered.

 

Senator Nichols sent up Committee Amendment 1, as amended, and moved adoption; without objection, the amendment was adopted. 

 

At 9:00 a.m. Senator Brimer assumed the chair. 

 

Senator Carona sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted. 

 

Senator Carona sent up Committee Amendment 3 and moved adoption; without objection, the amendment was adopted. 

 

At 9:05 a.m. Senator Watson assumed the chair. 

 

Senator Carona sent up Committee Amendment 4 and moved adoption; without objection, the amendment was adopted. 

 

Senator Carona sent up Committee Amendment 5 and moved adoption; without objection, the amendment was adopted. 

 

Senator Carona sent up Committee Amendment 6 and moved adoption; without objection, the amendment was adopted. 

 

Senator Brimer sent up Committee Amendment 7 and moved adoption.  The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent. 

 

Senator Brimer sent up Committee Amendment 8 and moved adoption; without objection, the amendment was adopted. 

 

Senator Brimer sent up Committee Amendment 9.  The amendment was withdrawn without objection. 

 

Senator Carona requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.

At 9:44 a.m. Senator Watson assumed the chair. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.
