Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Health & Human Services was held on Thursday, May 10, 2007, in hearing room E1.016 at Austin, Texas.

The Chair called the meeting to order at 9:04 a.m.  The following business was transacted:

 

At 9:05 a.m., Senator Shapleigh assumed the Chair.

 

The Chair laid out Senate Bill 1292 and recognized the author, Senator Nelson, to explain the bill. 

 

Senator Nelson sent up a committee substitute; the Chair recognized Senator Nelson to explain the difference between the committee substitute and the bill as filed. 

 

The Chair opened the floor to public testimony.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 9:11 a.m., Senator Deuell assumed the Chair.

 

At 9:54 a.m., Senator Nichols assumed the Chair.

Senator Nelson moved that SJR 43 do not pass but that CSSJR 43 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nays, 3 absent and 0 present not voting.

Senator Shapleigh moved adoption of Committee Amendment 1; without objection, the amendment was adopted. 

 

Senator Nelson requested unanimous consent to incorporate the amendment into a committee substitute, and that the new committee substitute be adopted; without objection, it was so ordered. 

 

Senator Nelson moved that SB 1292 do not pass but that CSSB 1292 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nays, 3 absent and 0 present not voting.

Senator Nelson moved that HB 643 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nays, 2 absent and 0 present not voting.

There being no further business, at 3:15 p.m. the Chair announced that the Committee would stand recessed subject to the call of the Chair.
