Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Thursday, May 3, 2007, at Senator Seliger's Desk on the Senate Floor in Austin, Texas.

Senator Kel Seliger, the acting chair, called the meeting to order at 3:32 p.m.  There being a quorum present, the following business was transacted: 

 

As a matter of pending business, the chair laid out HB 126.  Senator Ellis moved that HB 126 do not pass but that CSHB 126 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 3 absent.  Senator Carona moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out HB 184.  Senator Ellis moved that HB 184 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

As a matter of pending business, the chair laid out SB 1285.  Senator Ellis moved that SB 1285 do not pass but that CSSB 1285 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.  

 

The chair laid out HB 872 in lieu of SB 1393.  Senator Hegar moved that HB 872 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   

 

As a matter of pending business, the chair laid out SB 1593.  Senator Hinojosa sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Hinojosa requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Hinojosa then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Hinojosa moved that SB 1593 do not pass but that CSSB 1593 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.   

 

Senator Hinojosa requested that the Committee reconsider the vote on HB 914 to send up and adopt a committee substitute.  There being no objection, Senator Seliger laid out HB 914.  Senator Seliger sent up a committee substitute; the chair recognized Senator Hinojosa to explain the difference between the committee substitute and the house bill as engrossed.  Senator Hinojosa moved adoption of the committee substitute; without objection, it was so ordered.

Senator Hinojosa moved that HB 914 do not pass but that CSHB 914 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
