Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Tuesday, April 10, 2007, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 10:01 a.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out SB 262 and recognized the author, Senator Ellis, to explain the bill.  Senator Ellis sent up a committee substitute; the chair recognized Senator Ellis to explain the difference between the committee substitute and the senate bill as filed.  Senator Ellis moved adoption of the committee substitute; without objection, it was so ordered. 

 

At 10:13 a.m. Senator Seliger assumed the chair.

At 10:27 a.m. Senator Ellis assumed the chair.

At 10:37 a.m. Senator Seliger assumed the chair.

                                   

Witnesses testifying and registering on SB 262 are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Seliger moved that SB 262 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Ellis moved that SB 262 do not pass but that CSSB 262 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

At 10:56 a.m. Senator Seliger moved that the committee stand recessed until 1:30 p.m.; without objection, it was so ordered. 

 

Senator Whitmire called the committee back to order at 1:33 p.m. 

 

The chair laid out SB 263 and recognized the author, Senator Ellis, to explain the bill.  Senator Ellis sent up a committee substitute; the chair recognized Senator Ellis to explain the difference between the committee substitute and the senate bill as filed.  Senator Ellis moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Seliger moved that SB 263 be left pending to await a quorum; without objection, it was so ordered.  Upon arrival of a quorum, Senator Ellis moved that SB 263 do not pass but that CSSB 263 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

There being no further business, at 1:51 p.m. Senator Whitmire moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
