Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Natural Resources was held on Tuesday, May 1, 2007, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 8:00 a.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out SB 1693 and recognized the author, Senator Nelson, to explain the bill. 

 

Senator Seliger sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.  Senator Seliger moved adoption of the committee substitute; without objection, it was so ordered. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Averitt moved that SB 1693 be left pending; without objection, it was so ordered. 

 

Senator Hinojosa assumed the chair. 

 

The chair laid out SB 945 and recognized the author, Senator Ellis, to explain the bill. 

 

Senator Brimer sent up a committee substitute; the chair recognized Senator Ellis to explain the difference between the committee substitute and the senate bill as filed.  Senator Brimer moved adoption of the committee substitute; without objection, it was so ordered.

Senator Hinojosa moved that SB 945 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1687 and recognized the author, Senator Watson, to explain the bill. 

 

Senator Hegar sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.  Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered.

Senator Hinojosa moved that SB 1687 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 610 and recognized Senator Seliger, in the absence of the author, to explain the bill. 

 

Senator Seliger sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Hinojosa moved that SB 610 be left pending; without objection, it was so ordered. 

 

Senator Hinojosa moved that the committee stand recessed until after adjournment of the Senate; without objection, it was so ordered. 

 

At 5:55 p.m. the committee reconvened. 

 

The chair laid out pending business SB 1071.  A committee substitute had been adopted at a previous committee hearing. 

 

Senator Seliger moved that SB 1071 do not pass but that CSSB 1071 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out pending business SB 1895. 

 

Senator Uresti moved that SB 1895 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Uresti moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out pending business SB 2019. 

 

Senator Uresti moved that SB 2019 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Uresti moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out pending business SB 2029. 

 

Senator Seliger moved that SB 2029 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 610 and recognized the author, Senator Duncan, to explain the bill. 

 

Senator Duncan moved adoption of the committee substitute which had been sent up and explained previously; without objection, it was so ordered. 

 

Senator Duncan moved that SB 610 do not pass but that CSSB 610 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

Senator Duncan moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out pending business SB 1693.  Senator Seliger moved that the committee reconsider the vote by which the previous committee substitute was adopted; without objection, it was so ordered.

 

Senator Seliger sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Seliger requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Seliger then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Seliger moved that SB 1693 do not pass but that CSSB 1693 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out pending business SB 1687.  Senator Duncan moved to reconsider the vote by which the previous committee substitute was adopted; without objection, it was so ordered.

 

Senator Uresti sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Uresti requested unanimous consent to incorporate amendments into the committee substitute; without objection, it was so ordered.  Senator Uresti then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Uresti moved that SB 1687 do not pass but that CSSB 1687 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

There being no further business, Senator Averitt moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
