Pursuant to suspension of Senate Rules 11.10 and 11.18, a public hearing of the Senate Committee on State Affairs was held on Monday, May 21, 2007, in the Senate Chamber, Senator Robert Duncan's Desk, in Austin TX.

The chair called the meeting to order at 3:07 p.m.  Senators Duncan, Carona, Ellis, Lucio, Jr., and Van de Putte were all present.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business HB 2265 and recognized the Senate sponsor, Senator Averitt, to explain the bill. 

 

At 3:08 p.m. Senator Lucio, Jr. assumed the chair. 

 

Senator Duncan moved to reconsider the vote by which HB 2265 failed; without objection, it was so ordered

 

At 3:08 p.m. Senator Duncan resumed the chair. 

 

Senator Van de Putte moved that HB 2265, as amended, be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent. 

 

There being no further business, at 3:09 p.m. Senator Duncan moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
