Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Wednesday, May 16, 2007, in the Capitol Extension Auditorium, E1.004, and upon adjournment, at Senator Robert Duncan's desk in Austin, TX.

The chair called the meeting to order at 8:10 a.m.  The following business was transacted:

 

The chair laid out HB 472 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill.  Senator Van de Putte sent up Committee Amendment 1.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. The chair moved that HB 472 be left pending; without objection, it was so ordered.   

 

The chair laid out HB 3350 and recognized the Senate sponsor, Senator West, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that HB 3350 be left pending; without objection, it was so ordered.

At 9:55 a.m. Senator Van de Putte assumed the chair.  The chair laid out SB 1399 and in the absence of the author explained the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that the bill be left pending; without objection, it was so ordered.

 

At 10:12 a.m. Senator Van de Putte moved that the committee stand at ease; without objection it was so ordered.

 

At 10:14 a.m. Senator Van de Putte, the acting chair, reconvened the committee.

 

The chair laid out HB 2006 and HB 3057 and recognized the Senate sponsor, Senator Janek, to explain the bills.  Senator Van de Putte sent up Committee Amendment 1.  Senator Janek explained the Committee Amendment.  Witnesses testifying and registering on HB 2006 and HB 3057 are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair moved that the bills be left pending; without objection, it was so ordered. 

 

At 10:55 a.m. Senator Van de Putte, the acting chair, moved that the committee stand recessed until after adjournment of the Senate; without objection, it was so ordered. 

 

Upon adjournment, at 4:30 p.m., Senator Duncan reconvened the committee at his desk.

 

Upon arrival of a quorum, the chair requested the roll call.  Senators Duncan, Carona, Ellis, Fraser, Harris, Jackson, and Lucio, Jr., were all present.  A quorum was established at 4:30 p.m.  Senator Van du Putte arrived after the roll call.

 

The chair laid out as a matter of pending business HB 472.  Senator Duncan moved adoption of Committee Amendment 1; without objection, the amendment was adopted.    Senator Ellis moved that HB 472, as amended, be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent. 

 

The chair laid out as a matter of pending business HB 888.  Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered. Senator Lucio, Jr. moved that HB 888 do not pass but that CSHB 888 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.    Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.  Having been present when a quorum was established Senators Ellis and Van de Putte requested unanimous consent to be shown voting AYE on HB 888; without objection, it was so ordered.
