Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on International Relations & Trade was held on Monday, April 2, 2007, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 2:37 p.m.  There being a quorum present, the following business was transacted: 

 

Senator Estes moved adoption of the minutes from the previous hearing held on March 19, 2007; without objection, it was so ordered. 

 

At 2:38 p.m. Senator Patrick assumed the chair.

 

The chair laid out SB 781 and recognized the author, Senator Lucio, Jr., to explain the bill.    

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Lucio, Jr. moved that SB 781 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 1445 and recognized the author, Senator Lucio, Jr., to explain the bill.   

 

The following member arrived after the roll was called:  Senator Seliger. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Lucio, Jr. moved that SB 1445 be left pending; without objection, it was so ordered. 

 

Senator Lucio, Jr. moved to reconsider the vote by which SB 781 was reported favorably out of committee; without objection, it was so ordered.  SB 781 was back on the table for consideration.

 

Senator Lucio, Jr. sent up Committee Amendment 1 to SB 781 and moved adoption.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Having been present when a quorum was established, Senator Estes requested unanimous consent to be shown voting AYE on the Committee Amendment to SB 781; without objection, it was so ordered.  The record vote on Committee Amendment 1 to SB 781 reflects the motion in writing by Senator Estes.

 

Senator Lucio, Jr. moved to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Lucio, Jr. then moved that the new committee substitute be adopted; without objection, it was so ordered. 

 

Senator Lucio, Jr. moved that SB 781 be reported to the Senate with the recommendation that it do not pass but that the CSSB 781 adopted in lieu thereof be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Having been present when a quorum was established, Senator Estes requested unanimous consent to be shown voting AYE on the CSSB 781; without objection, it was so ordered.  The record vote on CSSB 781 reflects the motion in writing by Senator Estes.

 

Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 3:48 p.m. Senator Lucio, Jr. resumed the chair. 

 

There being no further business, at 3:48 p.m. Senator Lucio, Jr. moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
