Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, May 10, 2007, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 8:36 a.m.  The following business was transacted: 

 

Senator Zaffirini assumed the chair. 

 

The chair laid out SB 1848 and recognized Senator Ogden, in the absence of the author, to explain the bill.  Senator Zaffirini moved that SB 1848 be left pending to await public testimony; without objection, it was so ordered. 

 

Senator Ogden resumed the chair. 

 

 

 

 

 

The chair laid out SB 268 and recognized the author, Senator Patrick, to explain the bill.  Senator Ogden moved that SB 268 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out HB 1010 and recognized Senator Brimer, in the absence of the Senate sponsor, to explain the bill.  Senator Ogden moved that HB 1010 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out SB 1010 and recognized the author, Senator Patrick, to explain the bill.  Senator Ogden moved that SB 1010 be left pending to await public testimony; without objection, it was so ordered. 

 

The chair laid out SB 1848, which had been left pending earlier in the hearing.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 1848 be left pending; without objection, it was so ordered.

 

The chair laid out HB 1010, which had been left pending earlier in the hearing.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 1010 be left pending; without objection, it was so ordered.

 

The chair laid out SB 268, which had been left pending earlier in the hearing.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 268 be left pending; without objection, it was so ordered.

 

The chair laid out SB 1010, which had been left pending earlier in the hearing.  There being no witnesses, the chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 1010 be left pending; without objection, it was so ordered.

 

Senator Hinojosa assumed the chair. 

 

The chair laid out HB 3928 and recognized the Senate sponsor, Senator Ogden, to explain the bill.  Senator Ogden sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the house bill as engrossed.  Witnesses testifying and registering on the bill are shown on the attached list.  The bill was left pending temporarily.

The roll was called, and a quorum was established.

 

The chair laid out SJR 57, which had been left pending at a previous hearing.  Senator Ogden moved adoption of a committee substitute sent up at a previous hearing; without objection, it was so ordered.  Senator Williams moved that SJR 57 do not pass but that CSSJR 57 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Zaffirini, Senator Nelson, and Senator Whitmire requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out SB 1640, which had been left pending at a previous hearing.  Senator Williams moved adoption of a committee substitute sent up at a previous hearing; without objection, it was so ordered.  Senator Williams moved that SB 1640 do not pass but that CSSB 1640 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Zaffirini and Senator Nelson requested unanimous consent to be shown voting aye; without objection, it was so ordered.  Senator Williams moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 953 and the adopted committee substitute, both of which had been left pending at a previous hearing.  Senator Williams moved to reconsider the vote by which the committee substitute was adopted; without objection, it was so ordered.  Senator Williams moved to withdraw the committee substitute from further consideration; without objection, it was so ordered.  Senator Williams sent up a new committee substitute; the chair recognized Senator Williams to explain the difference between the new committee substitute and the senate bill as filed.  Senator Williams moved adoption of the new committee substitute; without objection, it was so ordered.  Senator Ogden moved that SB 953 be left pending; without objection, it was so ordered. 

 

Senator Hinojosa assumed the chair. 

 

The chair laid out HB 3928, which had been left pending temporarily earlier in the hearing.  Testimony on HB 3928 resumed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Ogden resumed the chair. 

 

Senator Ogden moved that HB 3928 be left pending; without objection, it was so ordered. 

 

There being no further business, at 10:40 a.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
