Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Standing Senate Subcommittee on Higher Education was held on Monday, March 12, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 3:25 p.m.  The following business was transacted: 

 

The chair laid out SB 273 and recognized the author, Senator Estes, to explain the bill. 

 

Names of witnesses who testified and registered for, against, or on the bill are on the attached list. The chair closed public testimony.

 

SB 273 was left pending to await a quorum.

 

The chair laid out SB 612 and recognized the author, Senator Lucio, to explain the bill. 

 

Senator Averitt sent up a committee substitute for SB 612. The chair recognized Senator Lucio to explain the difference between the committee substitute and the Senate bill as filed.

 

Names of witnesses who testified and registered for, against, or on the bill are on the attached list.  The chair closed public testimony.

 

SB 612 was left pending to await a quorum.

 

The chair laid out SB 161 and recognized Senator Averitt to explain the bill by Senator Wentworth. 

 

Names of witnesses who testified and registered for, against, or on the bill are on the attached list.  The chair closed public testimony.

 

Upon arrival of a quorum at 3:28 p.m., Senator Averitt moved that SB 161 be reported favorably to the full committee for its recommendation to the Senate that it do pass and be printed.  There being 3 ayes and 0 nays, SB 161 was reported favorably. 

 

Senator Averitt moved that the bill be reported to the full committee for its recommendation that the Administrative Committee certify it for placement on the Local and Uncontested Calendar. The motion was adopted by unanimous consent.

 

Senator Averitt moved that SB 273 be reported favorably to the full committee for its recommendation to the Senate that it do pass and be printed. There being 4 ayes and 0 nays,     SB 273 was reported favorably. 

 

Senator Averitt moved that the bill be reported to the full committee for its recommendation that the Administrative Committee certify it for placement on the Local and Uncontested Calendar. The motion was adopted by unanimous consent.

 

Senator Averitt moved adoption of the committee substitute for SB 612. The motion was adopted by unanimous consent. Senator Averitt moved that  SB 612 be reported to the full committee for its recommendation to the Senate that it do not pass, but that the committee substitute adopted in lieu thereof do pass and be printed. There being 4 ayes and 0 nays, the committee substitute for SB 612 was reported favorably. 

 

Senator Averitt moved that the bill be reported to the full committee for its recommendation that the Administrative Committee certify it for placement on the Local and Uncontested Calendar. The motion was adopted by unanimous consent.

Senator Patrick moved that SB 285 be reported favorably to the full committee for its recommendation to the Senate that it do pass and be printed. There being 4 ayes and 0 nays,     SB 285 was reported favorably. 

 

Having been present during the hearing, Senator Williams requested unanimous consent to be shown voting aye on SB 285. The motion was adopted by unanimous consent, and his vote was included in the total vote count.

 

Senator Patrick moved that the bill be reported to the full committee for its recommendation that the Administrative Committee certify it for placement on the Local and Uncontested Calendar. The motion was adopted by unanimous consent.

 

The chair laid out SB 480 and recognized Senator Shapiro to explain the bill by Senator Janek.

Senator Patrick moved that SB 480 be reported favorably to the full committee for its recommendation to the Senate that it do pass and be printed.  There being 4 ayes and 0 nays,    SB 480 was reported favorably. 

 

Having been present during the hearing, Senator Williams requested unanimous consent to be shown voting aye on SB 480. The motion was adopted by unanimous consent, and his vote was included in the total vote count.

 

Senator Patrick moved that the bill be reported to the full committee for its recommendation that the Administrative Committee certify it for placement on the Local and Uncontested Calendar. The motion was adopted by unanimous consent.

 

The chair laid out SB 523 and recognized the author, Senator Seliger, to explain the bill.  Senator Averitt sent up a committee substitute for SB 523 and moved its adoption. The motion was adopted by unanimous consent. The chair recognized Senator Seliger to explain the difference between the committee substitute and the Senate bill as filed.

Senator Patrick moved that  SB 523 be reported to the full committee for its recommendation to the Senate that it do not pass, but that the committee substitute adopted in lieu thereof do pass and be printed. There being 4 ayes and 0 nays, the committee substitute for SB 523 was reported favorably. 

 

Having been present during the hearing, Senator Williams requested unanimous consent to be shown voting aye on SB 523. The motion was adopted by unanimous consent, and his vote was included in the total vote count.

 

Senator Patrick moved that the bill be reported to the full committee for its recommendation that the Administrative Committee certify it for placement on the Local and Uncontested Calendar. The motion was adopted by unanimous consent.

 

Senator Patrick moved that the minutes of the March 5, 2007, hearing be approved. The motion was adopted by unanimous consent. 

 

There being no further business, at 3:39 p.m. Senator Averitt moved that the committee stand recessed, subject to the call of the chair.  The motion was adopted by unanimous consent.
