Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, April 17, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 7:34 a.m.  The following business was transacted: 

 

The chair laid out SB 1517 and recognized the author, Senator Janek, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 1517 pending to await a quorum.

 

The chair laid out HB 978 and recognized the Senate sponsor, Senator Jackson, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left HB 978 pending to await a quorum.

As a matter of pending business the chair laid out SB 1456.  Senator Janek moved adoption of the committee substitute; without objection, it was so ordered.  Senator Janek moved that SB 1456 do not pass but that CSSB 1456 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair laid out the subcommittee report on SB 1146.  Senator Shapiro moved that the subcommittee report on SB 1146 be adopted; there being no objection, it was so ordered.  Senator Shapiro  moved that SB 1146 do not pass but that CSSB 1146 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

At 9:40 a.m. Senator Shapiro resumed the chair. 

 

At 9:40 a.m. Senator Shapiro moved that the committee stand recessed until the call of the chair; without objection, it was so ordered. 

 

Pursuant to the suspension of Senate Rule 11.10(a) at 2:35 pm the committee reconvened at Senator Shapiro’s desk.

 

The clerk called the roll.  There being a quorum present the following business was transacted:

 

Senator Shapiro moved adoption of the minutes from the previous hearings held on April 12, 2007, and April 10, 2007; without objection, it was so ordered. 

 

Senator Janek assumed the chair. 

 

As a matter of pending business the chair laid out SB 1643 by Senator Shapiro.  Senator Shapiro moved to withdraw the pending committee substitute proposed on April 3rd.  Senator Shapiro sent up a new committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  Senator Shapiro moved adoption of the committee substitute; without objection, it was so ordered.  Senator Shapiro moved that SB 1643 do not pass but that CSSB 1643 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent. 

 

Senator Shapiro resumed the chair. 

 

As a matter of pending business the chair laid out SB 553 by Senator Shapleigh.  Senator West sent up a committee substitute; the chair recognized Senator Shapleigh to explain the difference between the committee substitute and the senate bill as filed.  Senator West moved adoption of the committee substitute; without objection, it was so ordered.  Senator West moved that SB 553 do not pass but that CSSB 553 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 2 nays, 0 present not voting, and 1 absent. 

 

 

 

There being no further business, at 2:44 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered. 

 

Senator Williams requested unanimous consent to be shown voting Aye for CSSB 1456, SB 1517, HB 708, HB 978, and CSSB 1146, and Nay on CSSB 1052.  There being no objection, it was so ordered.
