Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 27, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:30 a.m.  The following business was transacted: 

 

At 8:34 a.m. Senator Zaffirini assumed the chair. 

 

The chair laid out SB 1000 and recognized the author, Senator Shapiro, to explain the bill. 

 

At 8:56 a.m. Senator Van de Putte assumed the chair. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 10:10 a.m. Senator Patrick assumed the chair.  The chair left SB 1000 pending.

 

At 10:50 a.m. Senator Shapiro resumed the chair. 

 

At 10:53 a.m. Senator Shapiro moved that the committee stand recessed until after adjournment of the Senate; without objection, it was so ordered. 

 

At 2:20 p.m. the committee reconvened. 

 

The chair laid out SB 840 and recognized the author, Senator Lucio, Jr., to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 840 pending.

 

At 2:59 p.m. Senator Van de Putte assumed the chair. 

 

As a matter of pending business, the chair laid out SB 1000. 

 

At 4:26 p.m. Senator Williams assumed the chair. 

 

At 4:30 p.m. Senator Van de Putte assumed the chair. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 1000 pending to await a quorum

At 6:04 p.m. Senator Shapiro resumed the chair. 

 

The chair laid out SB 652 and recognized the author, Senator Seliger, to explain the bill.  Senator Janek sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed.   Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  The chair left SB 652 pending to await a quorum. 

 

At 6:26 p.m. Senator Shapiro moved that the committee stand recessed until 6:30 p.m.; without objection, it was so ordered. 

 

At 6:35 p.m. the committee reconvened.

Senator West moved adoption of the minutes from the previous hearings held on March 22, 2007, March 20, 2007, and March 15, 2007; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 652.  Senator Janek moved adoption of the committee substitute; without objection, it was so ordered.  Senator Janek moved that SB 652 do not pass but that CSSB 652 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent. 

 

As a matter of pending business, the chair laid out SB 840.  The Chair left SB 840 pending. 

 

The chair laid out the subcommittee report on SB 141.  Senator West then moved adoption of the subcommittee report; there being no objection, it was so ordered.  Senator West moved that SB 141 do not pass but that CSSB 141 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 161.  Senator West then moved adoption of the subcommittee report; there being no objection, it was so ordered.  The chair left SB 161 pending.

 

The chair laid out the subcommittee report on SB 276.  Senator West then moved adoption of the subcommittee report; there being no objection, it was so ordered.  Senator Williams sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.   Senator Williams requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Williams then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Williams moved that SB 276 do not pass but that CSSB 276 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Williams moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out the subcommittee report on SB 480.  Senator Williams then moved adoption of the subcommittee report; there being no objection, it was so ordered.  Senator Williams moved that SB 480 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Williams moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 530 and recognized Senator Janek on the bill in place of its author, Senator Nelson.  As a matter of pending business, the chair laid out Committee Amendments 1, 2, 3, and 4, and recognized their author, Senator Van de Putte, on the Amendments.  Senator Van de Putte withdrew Committee Amendment 2.  Senator Van de Putte moved adoption of Committee Amendments 1, 3, and 4.There being no objection to the adoption, the amendments were adopted.   Senator Janek sent up Committee Amendment 5 and moved adoption; without objection, the amendment was adopted.  Senator Van de Putte sent up Committee Amendment 6 and moved adoption; without objection, the amendment was adopted.  Senator Van de Putte sent up Committee Amendment 7 and moved adoption; without objection, the amendment was adopted.  Senator Van de Putte requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Van de Putte then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Van de Putte moved that SB 530 do not pass but that CSSB 530 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.

As a matter of pending business, the chair laid out SB 881 and recognized the author, Senator Shapiro, on the bill.  Senator Shapiro moved that the pending committee substitute be adopted, there being no objection, the substitute was adopted.  Senator Shapiro moved that SB 881 do not pass but that CSSB 881 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 1 present not voting, and 1 absent.  Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 1067 and recognized the author, Senator Shapiro, on the bill.  Senator Shapiro sent up a committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  Senator Shapiro moved adoption of the committee substitute; without objection, it was so ordered.  Senator Shapiro moved that SB 1067 do not pass but that CSSB 1067 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.

 

Senator Shapiro resumed the chair. 

 

As a matter of pending business, the chair laid out SB 8 and recognized the author, Senator Janek, on the bill.  Senator Janek sent up a committee substitute; the chair recognized Senator Janek to explain the difference between the committee substitute and the senate bill as filed.  Senator West sent up Committee Amendment 1; the amendment was left pending.  The chair left SB 8 pending.

As a matter of pending business, the chair laid out SB 1000 and recognized the author, Senator Shapiro, on the bill.  Senator Shapiro sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Shapiro sent up Committee Amendment 2.  Senator Shapiro withdrew Committee Amendment 2.  Senator Shapiro sent up Committee Amendment 3 and moved adoption; without objection, the amendment was adopted.  Senator Shapiro requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Shapiro then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Shapiro moved that SB 1000 do not pass but that CSSB 1000 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 3 nays, 0 present not voting, and 1 absent. 

 

Senator Averitt requested unanimous consent to be shown voting aye on CSSB 141, CSSB 276, and SB 480, there being no objection, it was so ordered.

 

Senator Zaffirini requested unanimous consent to be shown voting aye on CSSB 141, CSSB 276, SB 480, CSSB 530, CSSB 881, CSSB 1067 and nay on CSSB 1000; there being no objection, it was so ordered.

 

There being no further business, at 7:58 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
