Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 6, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:34 a.m. The following business was transacted:
The chair laid out SB 136 and recognized the author, Senator Nelson, to explain the bill. Senator Van de Putte sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list.
There being a quorum present, the clerk called the roll at 8:41 am.
Senator Zaffirini moved adoption of the minutes from the previous hearing held on February 27, 2007; without objection, it was so ordered.
Senator Van de Putte moved adoption of the committee substitute; without objection, it was so ordered. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Zaffirini moved that SB 136 do not pass but that CSSB 136 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
The chair laid out SB 606 and recognized the author, Senator Ogden, to explain the bill. Senator Ogden sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ogden moved adoption of the committee substitute; without objection, it was so ordered. Senator Ogden moved that SB 606 do not pass but that CSSB 606 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Ogden moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Zaffirini moved that SB 673 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.
The chair laid out SB 127 and recognized the author, Senator Shapleigh, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. The chair left SB 127 and public testimony on SB 127 pending; without objection, it was so ordered.
At 9:54 a.m. Senator Shapiro moved that the committee stand recessed until 30 minutes after adjournment of the Senate; without objection, it was so ordered.
At 12:31 p.m. the committee reconvened. At 12:31 p.m. Senator Patrick assumed the chair.
Senator Patrick brought back up SB 127 and reopened public testimony. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Patrick moved that SB 127 be left pending; without objection, it was so ordered.
The chair laid out SB 9 and recognized the author, Senator Shapiro, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list.
At 1:20 p.m. Senator Van de Putte assumed the chair.
The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Van de Putte moved that SB 9 be left pending; without objection, it was so ordered.
At 1:52 p.m. Senator Shapiro resumed the chair.
Senator Averitt requested unanimous consent to be shown voting aye on CSSB 606, CSSB 136, SB 673; there being no objection, it was so ordered.

There being no further business, at 1:52 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
