Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, February 6, 2007, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:32 a.m.  There being a quorum present, the following business was transacted: 

 

The chair made opening remarks, introduced staff, and recognized the members present to introduce their staff.

 

Senator Janek moved adoption of the Committee Rules; without objection, it was so ordered.

 

The chair laid out SB 135 and recognized the author, Senator Wentworth, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro moved that SB 135 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out SB 234 and recognized the author, Senator Harris, to explain the bill.  Senator Zaffirini sent up a committee substitute; the chair recognized Senator Harris to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro moved that SB 234 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out SB 282 and recognized Senator Zaffirini, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro moved that SB 282 be left pending to await a quorum; without objection, it was so ordered. 

 

At 9:31 a.m. Senator Shapiro moved that the committee stand recessed until a quorum was present; without objection, it was so ordered. 

 

At 9:38 a.m. the committee reconvened. 

 

Upon arrival of a quorum, Senator Patrick moved that SB 135 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

Upon arrival of a quorum, Senator Janek moved adoption of the committee substitute for SB 234; without objection, it was so ordered.  Senator Janek moved that SB 234 do not pass but that CSSB 234 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

Upon arrival of a quorum, Senator Janek moved that SB 282 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Upon arrival of a quorum, Senator Van de Putte moved that SB 113 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Shapiro requested unanimous consent to have Senator West be shown voting aye on the following bills: SB 113, SB 135, CSSB 234, and SB 282; there being no objection, it was so ordered.

There being no further business, at 9:44 a.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
