Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Business & Commerce was held on Tuesday, April 3, 2007, in the Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

The chair called the meeting to order at 8:30 a.m. 

 

The chair laid out SB 46 and recognized the author, Senator Nelson, to explain the bill. 

Senator Lucio, Jr. sent up a proposed committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Lucio moved to withdraw the proposed committee substitute to SB 46.  Without objection, it was so ordered. Senator Fraser moved that SB 46 be left pending; without objection, it was so ordered.

The subcommittee report on SB 1105 was laid out by the Chairman.  Senator Janek was recognized to explain the subcommittee report on CSSB 1105, adopted in subcommittee.  Senator Fraser stated that public testimony would not be reopened considering it had already been heard in subcommittee.  However, witnesses registering on the bill are shown on the attached list.  Senator Janek moved that SB 1105 do not pass but that CSSB 1105 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The subcommittee report on SB 1424 was laid out by the Chairman.  Senator Janek was recognized to explain the subcommittee report on SB 1424.  Senator Fraser stated that public testimony would not be reopened considering it had already been heard in subcommittee.  However, witnesses registering on the bill are shown on the attached list.  Senator Janek moved that SB 1424 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Janek moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
