A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to filling of a vacancy in an office of a county. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 87.041, Local Government Code, is |
|
amended to read as follows: |
|
§ 87.041. VACANCIES FILLED BY APPOINTMENT OF COMMISSIONERS |
|
COURT. (a) The commissioners court of a county may fill a vacancy |
|
in the office of: |
|
(1) county judge; |
|
(2) county clerk; |
|
(3) district and county clerk; |
|
(4) sheriff; |
|
(5) county attorney; |
|
(6) county treasurer; |
|
(7) county surveyor; |
|
(8) inspector of hides and animals; |
|
(9) county tax assessor-collector; |
|
(10) justice of the peace; or |
|
(11) constable. |
|
(b) The commissioners court shall fill a vacancy by a |
|
majority vote of the members of the court who are present and |
|
voting. |
|
(c) The person appointed by the commissioners court to fill |
|
the vacancy shall hold office until the next uniform election date |
|
as defined in Section 41.001, Election Code [general election]. |
|
SECTION 2. Section 87.042, Local Government Code, is |
|
amended to read as follows: |
|
§ 87.042. COUNTY COMMISSIONER VACANCY. If a vacancy |
|
occurs in the office of county commissioner, the county judge shall |
|
appoint a suitable resident of the precinct in which the vacancy |
|
exists to fill the vacancy until the next uniform election date as |
|
defined in Section 41.001, Election Code [general election]. |
|
SECTION 3. This Act takes effect September 1, 2007. |
