A BILL TO BE ENTITLED
AN ACT
relating to filling of a vacancy in an office of a county.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 87.041, Local Government Code, is
amended to read as follows:
       § 87.041.  VACANCIES FILLED BY APPOINTMENT OF COMMISSIONERS
COURT.  (a)  The commissioners court of a county may fill a vacancy
in the office of:
             (1)  county judge;
             (2)  county clerk;
             (3)  district and county clerk;
             (4)  sheriff;
             (5)  county attorney;
             (6)  county treasurer;
             (7)  county surveyor;
             (8)  inspector of hides and animals;
             (9)  county tax assessor-collector;
             (10)  justice of the peace; or
             (11)  constable.
       (b)  The commissioners court shall fill a vacancy by a
majority vote of the members of the court who are present and
voting.
       (c)  The person appointed by the commissioners court to fill
the vacancy shall hold office until the next uniform election date
as defined in Section 41.001, Election Code [general election].
       SECTION 2.  Section 87.042, Local Government Code, is
amended to read as follows:
       §  87.042.  COUNTY COMMISSIONER VACANCY.  If a vacancy
occurs in the office of county commissioner, the county judge shall
appoint a suitable resident of the precinct in which the vacancy
exists to fill the vacancy until the next uniform election date as
defined in Section 41.001, Election Code [general election].
       SECTION 3.  This Act takes effect September 1, 2007.
