A BILL TO BE ENTITLED
AN ACT
relating to the recreational facility fee at The University of
Texas at El Paso.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 54.541, Education Code, is amended by
amending Subsections (a) and (c) and adding Subsections (a-1) and
(a-2) to read as follows:
       (a)  The board of regents of The University of Texas System
may charge each student enrolled at The University of Texas at El
Paso a recreational facility fee [not to exceed $12 per student per
semester or summer session]. The fee may be used only for financing,
constructing, operating, maintaining, and improving new and
existing recreational sports facilities and programs at The
University of Texas at El Paso.
       (a-1)  A fee imposed under this section may not exceed:
             (1)  $70 per student for a term or semester of 10 weeks
or longer; or
             (2)  $50 per student for any other term or semester.
       (a-2)  Notwithstanding Subsection (a-1), for a term or
semester before the 2009 fall semester, a fee imposed under this
section may not exceed $20 per student for a semester or summer
session. This subsection expires September 1, 2009.
       (c)  The recreational facility fee may not be increased
[levied] unless the amount of the increase [fee] is approved [and
the amount of the fee is set] by a majority vote of those students
participating in a general student election called at The
University of Texas at El Paso for that purpose.
       SECTION 2.  The change in law made by this Act applies to
fees charged beginning with the 2007 fall semester.  A fee charged
for a term or semester before the 2007 fall semester is covered by
the law in effect immediately before the effective date of this Act,
and the former law is continued in effect for that purpose.
       SECTION 3.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
