  S.B. No. 545
 
 
 
 
AN ACT
  relating to the enforcement of commercial motor vehicle safety
  standards by certain peace officers.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subsection (f), Section 45.051, Code of Criminal
  Procedure, as amended by Chapters 281 and 357, Acts of the 79th
  Legislature, Regular Session, 2005, is reenacted and amended to
  read as follows:
         (f)  This article does not apply to:
               (1)  an offense to which Section 542.404 [or
  729.004(b)], Transportation Code, applies; or
               (2)  a violation of a state law or local ordinance
  relating to motor vehicle control, other than a parking violation,
  committed by a person who:
                     (A)  holds a commercial driver's license; or
                     (B)  held a commercial driver's license when the
  offense was committed.
         SECTION 2.  Subsection (b), Section 644.101, Transportation
  Code, is amended to read as follows:
         (b)  A police officer of any of the following municipalities
  is eligible to apply for certification under this section:
               (1)  a municipality with a population of 50,000
  [100,000] or more;
               (2)  a municipality with a population of 25,000 or more
  any part of which is located in a county with a population of
  500,000 [two million] or more;
               (3)  a municipality with a population of less than
  25,000:
                     (A)  any part of which is located in a county with
  a population of 2.4 million; and
                     (B)  that contains or is adjacent to an
  international port; [or]
               (4)  a municipality with a population of at least
  34,000 that is located in a county that borders two or more states;
  or
               (5)  a municipality any part of which is located in a
  county bordering the United Mexican States.
         SECTION 3.  This Act takes effect September 1, 2007.
