  H.B. No. 3769
 
 
 
 
AN ACT
  relating to the eligibility of an employee of a political
  subdivision of this state to be a member of the governing body of
  certain state agencies.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 5.053, Water Code, is amended by adding
  Subsection (c) to read as follows:
         (c)  Subsection (a)(2) does not apply to an employee of a
  political subdivision of this state.  If the United States
  Environmental Protection Agency determines that there will be a
  negative impact on the State of Texas' National Pollution Discharge
  Elimination Systems delegation, this subsection does not apply.
         SECTION 2.  Section 6.053, Water Code, is amended by adding
  Subsection (c) to read as follows:
         (c)  Subsection (b)(1) does not apply to an employee of a
  political subdivision of this state.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2007.
