AN ACT
|
|
|
relating to the eligibility of an employee of a political |
|
|
subdivision of this state to be a member of the governing body of |
|
|
certain state agencies. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 5.053, Water Code, is amended by adding |
|
|
Subsection (c) to read as follows: |
|
|
(c) Subsection (a)(2) does not apply to an employee of a |
|
|
political subdivision of this state. If the United States |
|
|
Environmental Protection Agency determines that there will be a |
|
|
negative impact on the State of Texas' National Pollution Discharge |
|
|
Elimination Systems delegation, this subsection does not apply. |
|
|
SECTION 2. Section 6.053, Water Code, is amended by adding |
|
|
Subsection (c) to read as follows: |
|
|
(c) Subsection (b)(1) does not apply to an employee of a |
|
|
political subdivision of this state. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
