A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority to consent to the administration of |
|
|
psychotropic drugs to certain foster children. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 266.004(i), Family Code, as added by |
|
|
Chapter 268, Acts of the 79th Legislature, Regular Session, 2005, |
|
|
is amended to read as follows: |
|
|
(i) The person authorized under Subsection (b) to consent to |
|
|
medical care of a foster child: |
|
|
(1) shall participate in each appointment of the child |
|
|
with the provider of the medical care; and |
|
|
(2) may not, unless the person is the child's parent, |
|
|
consent to the administration of a psychotropic drug to the child if |
|
|
the child is younger than five years old. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2007. |
