A BILL TO BE ENTITLED
AN ACT
relating to the authority to consent to the administration of
psychotropic drugs to certain foster children.
       BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
       SECTION 1.  Section 266.004(i), Family Code, as added by
Chapter 268, Acts of the 79th Legislature, Regular Session, 2005,
is amended to read as follows:
       (i)  The person authorized under Subsection (b) to consent to
medical care of a foster child:
             (1)  shall participate in each appointment of the child
with the provider of the medical care; and
             (2)  may not, unless the person is the child's parent,
consent to the administration of a psychotropic drug to the child if
the child is younger than five years old.
       SECTION 2.  This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution.  If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2007.
