AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Under current law, an appeal bond is required to contain certain recitations, but identifying information is not included in this requirement.  As such, appeal bonds are sent to the county clerk without this information, thereby delaying the process.

 

H.B. 1687 requires the defendant’s name, date of birth, and driver’s license or personal identification certificate number, if available, to be included in the appeal bond recitations.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Article 45.0425(b), Code of Criminal Procedure, to require an appeal bond to state the defendant's name, date of birth, and driver's license or personal identification certificate number, if available.  Makes conforming and nonsubstantive changes

 

SECTION 2.  Makes application of this Act prospective.

 

SECTION 3.  Effective date: September 1, 2007.
