BACKGROUND AND PURPOSE

 

During the reconstruction of the Texas Commission on the Arts, it created a mini grant process which made access to grants more efficient. Current state law reflects only toward the Texas Commission of the Arts annual grant process and does not reflect with all of the Commission=s current rules and practices.  For current state law to properly reflect the Commission=s rules and practices, it must be altered.  H.B. 1023 would alter current state law to properly reflect the current rules and practices of the Texas Commission on the Arts. 

 

RULEMAKING AUTHORITY

 

It is the opinion of this committee that this Act does not expressly grant any rulemaking authority to a state officer, agency, department, or institution. 

 

ANALYSIS

 

This bill amends the Government Code by allowing the commission to make grants for any purpose, providing those purposes are consistent with this code.  It clarifies language regarding the Commission's approval of grants of 500 dollars or more and approval of grants less than 500 dollars by the Executive Director with review by the Commission.

 

EFFECTIVE DATE

 

This act is effective immediately if a proper two-thirds vote is received from each chamber.  If a proper two-thirds vote is not received then this Act takes effect September 1, 2007.
