Amend CSSB 3 (House Committee Printing) in SECTION 2.07 of
the bill, by striking proposed Section 16.051(i), Water Code (page
43, lines 21 through 27), and substituting the following:
(i) A person may not bring a cause of action under
Subsection (h) for a violation of Subsection (g) if the state agency
or political subdivision that violated Subsection (g) acquired the
fee title or easement for the purpose of:
(1) constructing or expanding public utility
infrastructure;
(2) allowing an owner of property in the reservoir
site to improve or develop the property; or
(3) allowing an owner or lessee of the mineral estate
in property in the reservoir site to explore for, produce, or
transport the minerals.
