	Amend CSSB 3 (House Committee Printing) as follows:                          
	(1) In the recital to SECTION 2.07 of the bill (page 43, line 
20), strike "and (k)" and substitute "(k), and (l)".
	(2) In SECTION 2.07 of the bill, strike proposed Section 
16.051(i), Water Code (page 43, lines 21 through 27), and 
substitute the following:
	(i) A person may not bring a cause of action under Subsection 
(h) for a violation of Subsection (g) if the state agency or 
political subdivision that violated Subsection (g) acquired the fee 
title or easement for the purpose of:
		(1) constructing or expanding public utility 
infrastructure;         
		(2) allowing an owner of property in the reservoir site 
to improve or develop the property; or
		(3) allowing an owner or lessee of the mineral estate in 
property in the reservoir site to explore for, produce, or 
transport the minerals.
	(3) In SECTION 2.07 of the bill, following proposed Section 
16.051(k), Water Code (page 44, between lines 13 and 14), insert the 
following:
	(1) The designation under Subsection (g) of a site of unique 
value for the construction of a reservoir does not affect the 
requirements of this chapter or Chapter 11 regarding the permitting 
of or construction of a reservoir on the site.
