Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on Veteran
Affairs & Military Installations was held on Friday, May 13,
2005, in the Betty King Committee Hearing Room, 2E.20, at
Austin, Texas.

The chair called the meeting to order at 8:40 a.m. There being
a quorum present, the following business was transacted:
The chair recognized Steve Walker, who led the Committee in the
pledge of allegiance.
Senator Van de Putte moved adoption of the minutes from the
previous hearings held on April 13, 2005, April 27, 2005, April
29, 2005, and May 6, 2005; without objection, it was so ordered.
The chair laid out HB 3113 and recognized the Senate sponsor,
Senator Seliger, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered.
Senator Seliger moved that HB 3113 be reported favorably to the
Senate with the recommendation that it do pass and be printed.
The motion carried with a record vote of 4 ayes, 0 nay, 0
present not voting, and 1 absent. Senator Seliger moved that
the bill be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.
The chair laid out HB 3163 and recognized the Senate sponsor,
Senator Shapleigh, to explain the bill.
There being no witnesses testifying for, on, or against the
bill, the chair moved that the public testimony be closed.
Without objection, it was so ordered.
Senator Shapleigh moved that HB 3163 be reported favorably to
the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent. Senator Shapleigh
moved that the bill be recommended for placement on the Local &
Uncontested Calendar; without objection, it was so ordered.
Senator Estes was shown voting aye on the following bill: HB
3113.
At 8:50 a.m. Senator Estes assumed the chair.
The chair laid out HB 2336 and recognized the Senate sponsor,
Senator Van de Putte, to explain the bill.

The chair laid out SB 774 and recognized the author, Senator Van
de Putte, to explain the bill.
Senator Van de Putte moved to reconsider the vote by which the
committee substitute to SB 774 was adopted previously. Without
objection, it was so ordered.
Senator Van de Putte moved to withdraw from consideration the
committee substitute to SB 774, which was adopted previously.
Without objection, it was so ordered.
Senator Van de Putte sent up a new committee substitute; the
chair recognized Senator Van de Putte to explain the difference
between the committee substitute and the bill as filed.
Witnesses testifying and registering on the bill are shown on
the attached list. The chair moved that the public testimony be
closed; without objection, it was so ordered.
The chair recognized Senator Shapleigh to read the BRAC list to
the Committee.
The following member arrived after the roll was called:
Senator Troy Fraser at 9:20 a.m.
Senator Van de Putte moved adoption of the committee substitute;
without objection, it was so ordered. Senator Van de Putte
moved that SB 774 do not pass but that CSSB 774 be reported back
to the Senate with the recommendation that it do pass and be
printed. The motion carried with a record vote of 4 ayes, 0
nay, 0 present not voting, and 1 absent.
At 9:25 a.m. Senator Van de Putte resumed the chair.
There being no further business, at 9:25 a.m. Senator Van de
Putte moved that the Committee stand recessed subject to the
call of the chair. Without objection, it was so ordered.
