         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Agriculture and Coastal Resources was held on Thursday, April 7,  
         2005, in the Capitol Extension, Room E1.012, at Austin, Texas.

         The chair called the meeting to order at 9:07 a.m.  
          
         The chair laid out SB 1707 and recognized the author, Senator  
         Staples, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Jackson moved that SB  
         1707 be left pending to await a quorum; without objection, it  
         was so ordered.   
          
         The chair laid out SB 1709 and recognized the author, Senator  
         Staples, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Jackson moved that SB  
         1709 be left pending to await a quorum; without objection, it  
         was so ordered.   
          
         The chair laid out SB 1708 and recognized the author, Senator

         full committee with the recommendation that it do pass and be

         Senator Madla moved that SB 1708 be reported favorably to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 3 ayes, 0  
         nay, 0 present not voting, and 0 absent.   
          
         Senator Madla moved that SB 1709 be reported favorably to the  
         full committee with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 3 ayes, 0  
         nay, 0 present not voting, and 0 absent.   
          
         The chair laid out SB 1040 and recognized the author, Senator  
         Janek, to explain the bill.  Senator Madla sent up a committee  
         substitute; the chair recognized Senator Janek to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Madla moved adoption of the committee  
         substitute; without objection, it was so ordered.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered. Senator Madla moved that  
         SB 1040 do not pass but that CSSB 1040 be reported back to the  
         full committee with the recommendation that it do pass and be

         the absence of the author, to explain the bill.  Senator Jackson  
         sent up a committee substitute; the chair recognized Senator  
         Jackson to explain the difference between the committee  
         substitute and the bill as filed.  Senator Jackson moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Jackson moved that SB 1686 do not pass but  
         that CSSB 1686 be reported back to the full committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 0 absent.   
          
         The chair recognized Senator Jackson, in the absence of the  
         author, to bring up pending business, SB 1192.  Senator Jackson  
         sent up a committee substitute; the chair recognized Senator  
         Jackson to explain the difference between the committee  
         substitute and the bill as filed.  Senator Jackson moved  
         adoption of the committee substitute; without objection, it was  
         so ordered.  Senator Jackson sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator Jackson requested unanimous consent to incorporate  
         amendments into the committee substitute; without objection, it  
         was so ordered.  Senator Jackson then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Senator Jackson moved that SB 1192 do not pass but  
         that CSSB 1192 be reported back to the full committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 0 nay, 0 present not  
         voting, and 0 absent.   
          
         At 9:50 a.m. Senator Jackson resumed the chair.    
          
         The following member arrived after the roll was called:

         Senator Estes requested with unanimous consent to be shown  
         voting aye for all of the bills heard today.  Without objection,  
         it was so ordered, (The record shows all three members' votes). 
          
         Senator Madla moved adoption of the minutes from the previous  
         hearing held on March 30, 2005; without objection, it was so  
         ordered.    
          
         There being no further business, at 9:51 a.m. Senator Jackson  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
