         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on State Affairs  
         was held on Thursday, April 14, 2005, in the Senate Chamber at  
         Austin, Texas.

         The chair called the meeting to order at 1:52 p.m.  There being a  
         quorum present, the following business was transacted:   
          
         Senator Williams assumed the chair.   
          
         The chair laid out pending business SB 852 and recognized the author,  
         Senator Shapleigh, to explain the bill.  Senator Williams sent up  
         Committee Amendment 1.  Senator Williams sent up Committee Amendment  
         2.  The bell was left pending before the committee. 
          
         The chair laid out SB 601 and recognized Senator Duncan, in the  
         absence of the author, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The chair  
         moved that the public testimony be closed; without objection, it was  
         so ordered.  Senator Duncan moved that SB 601 be left pending to await  
         a quorum; without objection, it was so ordered.  Upon arrival of a  
         quorum, Senator Lucio, Jr. moved that SB 601 be reported favorably to  
         the Senate with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 9 ayes, 0 nay, 0 present not  
         voting, and 0 absent.  Senator Lucio, Jr. moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar; without  
         objection, it was so ordered.   
          
         The chair laid out SB 698 and recognized the author, Senator Duncan,  
  
         to explain the bill.  Senator Duncan sent up a committee substitute;  
         the chair recognized Senator Duncan to explain the difference between  
         the committee substitute and the bill as filed.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The chair  
         moved that the public testimony be closed; without objection, it was  
         so ordered.  The bill was left pending before the committee.   
          
         Senator Duncan resumed the chair.   
          
         The chair laid out SB 1448 and recognized the author, Senator Averitt,  
         to explain the bill.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.  Senator  
         Duncan moved that SB 1448 be left pending to await a quorum; without  
         objection, it was so ordered.  Upon arrival of a quorum, Senator  
         Harris moved that SB 1448 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion carried  
         with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0  
         absent.  Senator Harris moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without objection, it  
         was so ordered.   
          
         The chair laid out SB 1532 and recognized the author, Senator Averitt,  
         to explain the bill.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.  Senator  
         Duncan moved that SB 1532 be left pending to await a quorum; without  
         objection, it was so ordered.  Upon arrival of a quorum, Senator  
         Harris moved that SB 1532 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion carried  
         with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0  
         absent.  Senator Williams moved that the bill be recommended for  
         placement on the Local & Uncontested Calendar; without objection, it  
         was so ordered.   
          
         The chair laid out SB 1319 and recognized Senator Averitt, in the  
         absence of the author, to explain the bill.  Senator Williams sent up  
         Committee Amendment 1.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.  Senator  
         Duncan moved that SB 1319 be left pending to await a quorum; without  
         objection, it was so ordered.  Upon arrival of a quorum, Committee  
         Amendment 1 was adopted without objection.  Senator Williams requested  
         unanimous consent to roll the amendments into a committee substitute;  
         without objection, it was so ordered.  Senator Williams then moved  
         that the committee substitute be adopted; without objection, it was so  
         ordered.  Senator Fraser moved that SB 1319 do not pass but that CSSB  
         1319 be reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 9 ayes,  
         0 nay, 0 present not voting, and 0 absent.   
          
         The chair laid out pending business SB 809.  Senator Armbrister sent  
         up Committee Amendment 3.  The bill was left pending before the  
         committee.   
          
         The chair laid out SB 1176 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Armbrister sent up a  
         committee substitute; the chair recognized Senator Armbrister to  
         explain the difference between the committee substitute and the bill  
         as filed.  Senator Armbrister sent up Committee Amendment  1 for  
         discussion purposes.  Senator Armbrister sent up Committee Amendment 2  
         for discussion purposes.  The bill was left pending before the  
         committee.   
          
         The chair laid out pending business SB 1510.  Senator Ellis had  
         offered a committee substitute at a previous hearing.  Senator  
         Williams moved adoption of the committee substitute; without  
         objection, it was so ordered.  Upon arrival of a quorum, Senator  
         Williams moved that SB 1510 do not pass but that CSSB 1510 be reported  
         back to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0  
         present not voting, and 0 absent.  Senator Lucio, Jr. moved that the  
         bill be recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         Senator Williams assumed the chair.

         to explain the bill.  Senator Duncan sent up a committee substitute;  
         the chair recognized Senator Duncan to explain the difference between
