         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Finance was  
         held on Friday, April 28, 2006, in the Capitol Extension, Room  
         E1.036, at Austin, Texas.

         The chair called the meeting to order at 10:03 a.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out HB 4 and recognized the Senate sponsor,  
         Senator Janek, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
         The chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Ogden moved that HB 4 be  
         left pending; without objection, it was so ordered.   
          
         The chair laid out HB 2 and recognized the Senate sponsor,  
         Senator Williams, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.   
          
         Senator Zaffirini assumed the chair.   
          
         Testimony continued. 
  
         Senator Ogden resumed the chair.   
          
         The chair moved that the public testimony be closed; without  
         objection, it was so ordered. Senator Ogden moved that HB 2 be  
         left pending; without objection, it was so ordered.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out HB 3 and recognized the Senate sponsor,  
         Senator Ogden, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Zaffirini moved that HB 3  
         be left pending; without objection, it was so ordered.   
          
         Senator Ogden resumed the chair.   
          
         At 1:12 p.m. Senator Ogden moved that the Committee stand  
         recessed until 1:45 p.m..  Without objection, it was so ordered.   
          
         The Committee reconvened at 2:55 p.m. 
          
         The roll was called; a quorum was present. 
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out HB 3, which had been left pending earlier in  
         the hearing.  Senator Ogden moved that HB 3 be reported  
         favorably to the Senate with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 9  
         ayes, 4 nays, 0 present not voting, and 0 absent.   
          
         Senator Ogden moved that the vote on HB 3 be left open; without  
         objection, it was so ordered. 
          
         Senator Ogden resumed the chair.   
          
         At 2:57 p.m. Senator Ogden moved that the Committee stand  
         recessed until 4:00 p.m.; without objection, it was so ordered. 
          
         The Committee reconvened at 4:09 p.m. 
          
         The chair laid out HB 2, which had been left pending earlier in  
         the hearing.  Senator Williams sent up a committee substitute;  
         the chair recognized Senator Williams to explain the difference  
         between the committee substitute and the bill as filed.   
          
         Senator Zaffirini assumed the chair.   
          
         Senator Ogden resumed the chair.   
          
         Senator Ogden moved to show Senator Averitt and Senator Madla as  
         being present at the hearing.  Senator Averitt and Senator Madla  
         requested unanimous consent to be shown voting aye on HB 3;  
  
         without objection, it was so ordered.  The motion finally  
         carried with a record vote of 11 ayes, 4 nays, 0 present not  
         voting, and 0 absent.   
          
         Senator Ogden moved that HB 2 be left pending temporarily;  
         without objection, it was so ordered. 
          
         The chair laid out HB 4, which had been left pending earlier in  
         the hearing.  Senator Janek sent up a committee substitute; the  
         chair recognized Senator Janek to explain the difference between  
         the committee substitute and the bill as filed.  Senator Janek  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator Janek moved that HB 4 do not pass  
         but that CSHB 4 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 11 ayes, 4 nays, 0 present not  
         voting, and 0 absent.   
          
         The chair laid out HB 2, which had been left pending earlier in  
         the hearing.   Senator Williams moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Williams moved that HB 2 do not pass but that CSHB 2 be reported  
         back to the Senate with the recommendation that it do pass and  
         be printed.  The motion carried with a record vote of 11 ayes, 4  
         nays, 0 present not voting, and 0 absent.   
          
         Senator Ogden announced that the Committee hearing for Saturday,  
         April 29, 2006 was cancelled. 
          
         Senator Ogden set an amendment deadline for SB 6 at 5:00 p.m. on  
         Saturday, April 29, 2006. 
          
         There was no action taken for the following bill(s):  HB 1. 
          
         There being no further business, at 5:10 p.m. Senator Ogden  
         moved that the Committee stand recessed until 2:00 p.m., Sunday,  
         April 30, 2006.  Without objection, it was so ordered.
