         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on Finance was  
         held on Monday, May 9, 2005, in the Capitol Extension, Room  
         E1.036, at Austin, Texas.

         The chair called the meeting to order at 9:40 a.m.  The  
         following business was transacted:   
          
         The roll was called. 
          
         A quorum was established. 
          
         The chair laid out SB 12 and recognized the author, Senator  
         Zaffirini, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Zaffirini to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Zaffirini sent up Committee Amendment 1  
         and moved adoption; without objection, the amendment was  
         adopted.  Senator West sent up Committee Amendment 2 and moved  
         adoption; without objection, the amendment was adopted.   
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Ogden  
         moved that SB 12 be left pending until a time certain vote;  
         without objection, it was so ordered.   
          
         The chair laid out SB 1020 and recognized the author, Senator  
         Barrientos, to explain the bill.  Senator Barrientos sent up a  
         committee substitute; the chair recognized Senator Barrientos to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Ogden moved that SB 1020 be left pending until a time  
         certain vote; without objection, it was so ordered.   
          
         The chair laid out SB 1325 and recognized the author, Senator  
         Armbrister, to explain the bill.  Senator Zaffirini sent up a  
         committee substitute; the chair recognized Senator Armbrister to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Ogden moved that SB 1325 be left pending; without  
         objection, it was so ordered.   
          
         Senator Zaffirini assumed the chair.   
          
         The chair laid out SB 1605 and recognized the author, Senator  
         Ogden, to explain the bill.  Senator Ogden sent up a committee  
         substitute; the chair recognized Senator Ogden to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Zaffirini moved that SB 1605 be left pending  
         until a time certain vote; without objection, it was so ordered.   
          
         The chair laid out SB 1606 and recognized the author, Senator  
         Ogden, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Zaffirini moved that SB  
         1606 be left pending until a time certain vote; without  
         objection, it was so ordered.   
          
         Senator Ogden resumed the chair.   
          
         The chair laid out SB 1652 and recognized the author, Senator  
         Staples, to explain the bill.  Senator Staples sent up a  
         committee substitute; the chair recognized Senator Staples to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Ogden moved that SB 1652 be left pending until a time  
         certain vote; without objection, it was so ordered.   
          
         At 11:10 a.m. Senator Ogden moved that the Committee stand  
         recessed until 11:30 a.m.; without objection, it was so ordered. 
          
         The Committee reconvened at 11:35 a.m. 
          
         The chair laid out SB 12, which had been left pending earlier in  
         the hearing.  Senator Ogden requested unanimous consent to roll  
         the amendments into the committee substitute; without objection,  
         it was so ordered.  Senator Ogden then moved that the committee  
         substitute be adopted; without objection, it was so ordered.   
         Senator Ogden moved that SB 12 do not pass but that CSSB 12 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of  
         10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator  
         Zaffirini and Senator Barrientos requested unanimous consent to  
         be shown voting aye; without objection, it was so ordered. 
          
         The chair laid out SB 1020, which had been left pending earlier  
         in the hearing.  Senator Shapleigh moved adoption of a committee  
         substitute sent up earlier in the hearing; without objection, it  
         was so ordered.  Senator Shapleigh moved that SB 1020 do not  
         pass but that CSSB 1020 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 10 ayes, 0 nay, 0 present not  
         voting, and 5 absent.  Senator Zaffirini and Senator Barrientos  
         requested unanimous consent to be shown voting aye; without  
         objection, it was so ordered. 
          
         Senator Nelson assumed the chair.   
          
         The chair laid out SB 1605, which had been left pending earlier  
         in the hearing.  Senator Ogden moved adoption of a committee  
         substitute sent up earlier in the hearing; without objection, it  
         was so ordered.  Senator Ogden moved that SB 1605 do not pass  
         but that CSSB 1605 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 10 ayes, 0 nay, 0 present not  
         voting, and 5 absent.  Senator Zaffirini and Senator Barrientos  
         requested unanimous consent to be shown voting aye; without  
         objection, it was so ordered.  Senator Ogden moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out SB 1606, which had been left pending earlier  
         in the hearing.  Senator Ogden sent up a committee substitute;  
         the chair recognized Senator Ogden to explain the difference  
         between the committee substitute and the bill as filed.  Senator  
         Ogden moved adoption of the committee substitute; without  
         objection, it was so ordered.  Senator Ogden moved that SB 1606  
         do not pass but that CSSB 1606 be reported back to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 10 ayes, 0 nay, 0 present  
         not voting, and 5 absent.  Senator Zaffirini and Senator  
         Barrientos requested unanimous consent to be shown voting aye;  
         without objection, it was so ordered.   
          
         Senator Ogden resumed the chair.   
          
         The chair laid out SB 1652, which had been left pending earlier  
         in the hearing.  Senator Staples moved adoption of a committee  
  
         substitute sent up earlier in the hearing; without objection, it  
         was so ordered.  Senator Staples moved that SB 1652 do not pass  
         but that CSSB 1652 be reported back to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried

         5 absent.  Senator Zaffirini and Senator Barrientos requested  
         unanimous consent to be shown voting aye; without objection, it  
         was so ordered. 
          
         The chair laid out SB 1351, which had been left pending at a  
         previous hearing.  Senator Williams sent up a committee  
         substitute; the chair recognized Senator Williams to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Williams moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Williams moved that SB 1351 do not pass but that CSSB 1351 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of  
         10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator  
         Zaffirini and Senator Barrientos requested unanimous consent to  
         be shown voting aye; without objection, it was so ordered. 
          
         There was no action taken on the following bill:  SB 1595 by  
         Lucio. 
          
         There being no further business, at 12:03 p.m. Senator Ogden  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
