         Pursuant to suspension of Senate Rule 11.18, a public hearing of  
         the Standing Senate Subcommittee on Higher Education was held on  
         Tuesday, March 22, 2005, in the Senate Chamber at Austin, Texas.

         The posting rule, Senate Rule 11.18, was suspended to hear the  
         following bill(s): SB 114, SB 528. 
          
         The chair called the meeting to order at 12:32 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out SB 114 and recognized the author, Senator Van  
         de Putte, to explain the bill.  Senator Janek moved that SB 114  
         be reported favorably to the Full Committee with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 2 absent.   
          
         The chair laid out SB 528 and recognized the author, Senator  
         Hinojosa, to explain the bill.  Senator Averitt sent up a  
         committee substitute; the chair recognized Senator Hinojosa to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Averitt moved adoption of the committee  
         substitute; without objection, it was so ordered.  Senator  
         Averitt moved that SB 528 do not pass but that CSSB 528 be  
         reported back to the Full Committee with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 5 ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         There being no further business, at 12:36 p.m. Senator West  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
