         Pursuant to suspension of Senate Rule 11.18, a public hearing of  
         the Senate Committee on Education was held on Friday, April 29,  
         2005, in the Capitol Extension, Room E1.028, at Austin, Texas.

         The posting rule, Senate Rule 11.18, was suspended to hear the

         Senator Shapiro called the meeting to order at 4:02 p.m.  There  
         being a quorum present, the following business was transacted on  
         HB 2, sponsored by Senator Shapiro:

         recessed for 5 minutes; without objection, it was so ordered.   
          
         At 5:39 p.m. the committee reconvened, Senator Shapiro in chair. 
          
         At 5:39 p.m. Senator Janek assumed the chair.  
          
         Senator Averitt moved to reconsider the motion by which  
         Committee Amendment 14 was adopted; there being no objection, it  
         was so ordered.  Committee Amendment 14 was then pulled down.   
         Senator Averitt sent up Committee Amendment 14(a) and moved  
         adoption; without objection, the amendment was adopted.     
          
         Public testimony was closed on HB 2. 
          
         Senator Shapiro requested unanimous consent to roll the  
         amendments into the committee substitute; without objection, it  
         was so ordered.  Senator Shapiro then moved that the committee  
         substitute be adopted; without objection, it was so ordered.   
         Senator Shapiro moved that HB 2 do not pass but that CSHB 2 be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 5  
         ayes, 0 nay, 2 present not voting, and 2 absent.    
          
         There being no further business, at 5:43 p.m. Senator Shapiro  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
