         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on  
         Intergovernmental Relations was held on Monday, May 2, 2005, in  
         the Betty King Committee Hearing Room, 2E.20, at Austin, Texas.

         The chair called the meeting to order at 12:01 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         The chair laid out pending business SB 760.  Senator Gallegos,  
         Jr. moved that SB 760 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Gallegos, Jr. moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 828.  Senator Gallegos,  
         Jr. moved that SB 828 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out pending business SB 892.  Both Amendments  
         sent up on April 28th were pulled down and Senator Wentworth  
         moved that SB 892 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         The chair laid out SB 1884 and recognized the author, Senator  
         Ellis, to explain the bill.  Witnesses registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Wentworth moved that SB 1884 be reported favorably to  
  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 1 absent.  Senator Wentworth  
         moved that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1136.  Motion to report  
         SB 1136 favorably to the Senate was pulled down; without  
         objection, it was so ordered.  Senator Madla moved that SB 1136  
         be left pending; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1458.  The committee  
         substitute laid out on April 28th was withdrawn.  Senator  
         Wentworth moved that SB 1458 be reported favorably to the Senate  
         with the recommendation that it do pass and be printed.  The  
         motion carried with a record vote of 4 ayes, 0 nay, 0 present  
         not voting, and 1 absent.   
          
         The chair laid out pending business SB 1692.  Senator Brimer  
         moved that SB 1692 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Brimer moved that the bill be  
         recommended for placement on the Local & Uncontested Calendar;  
         without objection, it was so ordered.   
          
         The chair laid out pending business SB 1820.  Senator Madla sent  
         up a committee substitute and explained the difference between  
         the committee substitute and the bill as filed.  Senator Madla  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Senator Gallegos, Jr. moved that SB 1820 do  
         not pass but that CSSB 1820 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Gallegos, Jr. moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1846.  Senator Gallegos,  
         Jr. moved that SB 1846 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Gallegos, Jr. moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1856.  Senator Deuell  
         sent up a committee substitute on April 28th.  Senator Madla  
         moved adoption; without objection, the amendment was adopted.   
         Senator Gallegos, Jr. moved that SB 1856, as amended, be  
         reported back to the Senate with the recommendation that it do  
         pass and be printed.  The motion carried with a record vote of 4  
         ayes, 0 nay, 0 present not voting, and 1 absent.   
          
         The chair laid out pending business SB 1872.  Senator Gallegos,  
  
         Jr. moved that SB 1872 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Gallegos, Jr. moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 1873.  Senator Gallegos,  
         Jr. moved that SB 1873 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.  Senator Gallegos, Jr. moved that the bill  
         be recommended for placement on the Local & Uncontested  
         Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SJR 44.  Senator Gallegos,  
         Jr. moved that SJR 44 be reported favorably to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 4 ayes, 0 nay, 0 present not  
         voting, and 1 absent.   
          
         There was no action taken for the following bill(s): SB 1453 
          
         There being no further business, at 12:16 p.m. Senator Madla  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
