         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Senate Committee on  
         Intergovernmental Relations was held on Thursday, April 28,  
         2005, in the Extension Auditorium

         Senator Kim Brimer, the acting chair, called the meeting to  
         order at 2:15 p.m.  There being a quorum present, the following  
         business was transacted:   
          
         The chair laid out SB 1440 and recognized the author, Senator  
         Hinojosa, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Brimer moved that SB 1440  
         be reported favorably to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.   
         Senator Deuell moved that the bill be recommended for placement  
         on the Local & Uncontested Calendar; without objection, it was  
         so ordered.   
          
         The chair laid out SB 841 and recognized the author, Senator  
         Lindsay, to explain the bill.  Senator Deuell sent up a proposed  
         committee substitute; the chair recognized Senator Lindsay to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Deuell sent up Committee Amendment 1 and  
         moved adoption; without objection, the amendment was adopted.   
         Senator Deuell requested unanimous consent to roll the amendment  
         into the body of the committee substitute; without objection, it  
         was so ordered.  Senator Deuell then moved that the new  
         committee substitute be adopted; without objection, it was so  
         ordered.  Witnesses registering on the bill are shown on the  
         attached list.  The chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Wentworth  
  
         moved that SB 841 do not pass but that CSSB 841 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 0 absent.  Senator Deuell moved  
         that the bill be recommended for placement on the Local &  
         Uncontested Calendar; without objection, it was so ordered.   
          
         The chair laid out pending business SB 430.  Senator Deuell sent  
         up a committee substitute; the chair recognized Senator Lindsay  
         to explain the difference between the committee substitute and  
         the bill as filed.  Senator Deuell moved adoption of the  
         committee substitute; without objection, it was so ordered.   
         Senator Brimer moved that SB 430 be left pending; without  
         objection, it was so ordered.   
          
         The chair laid out SB 356 and recognized the author, Senator  
         Ellis, to explain the bill.  Senator Wentworth sent up a  
         committee substitute; the chair recognized Senator Ellis to  
         explain the difference between the committee substitute and the  
         bill as filed.  Senator Wentworth moved adoption of the  
         committee substitute; without objection, it was so ordered.

         Senator Brimer moved adoption of the minutes from the previous  
         hearings held on April 19, 2005, April 20, 2005, and April 21,  
         2005; without objection, it was so ordered.   
          
         The chair laid out SB 1879 and recognized the author, Senator  
         Wentworth, to explain the bill.  Witnesses testifying and  
         registering on the bill are shown on the attached list.  The  
         chair moved that the public testimony be closed; without

         registering or testifying on this bill.  The chair moved that

         favorably to the Senate with the recommendation that it do pass

         assumed the chair.  Senator Madla was recognized in the absence  
         of the author.  Senator Madla sent up a committee substitute;  
         the chair recognized Senator Madla to explain the difference  
         between the committee substitute and the bill as filed.  Senator  
         Madla moved adoption of the committee substitute; without  
         objection, it was so ordered.  Senator Madla moved that SB 57 do  
         not pass but that CSSB 57 be reported back to the Senate with  
         the recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 3 ayes, 1 nay, 0 present not

         The chair laid out pending business CSSB 430.  Senator Madla was  
         recognized in the absence of the author.  Senator Madla moved  
         that SB 430 do not pass but that CSSB 430 be reported back to  
         the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 4 ayes, 0  
         nay, 0 present not voting, and 1 absent.   
          
         Senator Madla resumed the chair.   
          
         The chair laid out SB 1296 and recognized the author, Senator  
         Deuell, to explain the bill.  Senator Deuell sent up a committee  
         substitute; the chair recognized Senator Deuell to explain the  
         difference between the committee substitute and the bill as  
         filed.  Senator Deuell moved adoption of the committee  
         substitute; without objection, it was so ordered.  There were no  
         witnesses registering or testifying on this bill.  The chair

         was so ordered.  Senator Deuell moved that SB 1296 do not pass  
         but that CSSB 1296 be reported back to the Senate with the

         sent up Committee Amendment 1.  Senator Wentworth sent up  
         Committee Amendment 2 and explained.  Senator Madla moved that

         Wentworth, to explain the bill.  Senator Wentworth sent up a
