Pursuant to a notice posted in accordance with Senate Rule
11.18, a public hearing of the Senate Committee on
Intergovernmental Relations was held on Wednesday, March 30,
2005, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 9:01 a.m. There being
a quorum present, the following business was transacted:
The chair laid out SB 369 and recognized the author, Senator
Barrientos, to explain the bill. Witnesses testifying and
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Madla moved that SB 369
be left pending; without objection, it was so ordered.
The chair laid out SB 706 and recognized the author, Senator
Barrientos, to explain the bill. Senator Deuell sent up a
committee substitute; the chair recognized Senator Barrientos to
explain the difference between the committee substitute and the
bill as filed. Senator Deuell moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Deuell moved that SB 706
do not pass but that CSSB 706 be reported back to the Senate
with the recommendation that it do pass and be printed. The
motion carried with a record vote of 5 ayes, 0 nay, 0 present
not voting, and 0 absent. Senator Deuell moved that the bill be
recommended for placement on the Local & Uncontested Calendar;
without objection, it was so ordered.
The chair laid out SB 848 and recognized the author, Senator
Shapiro, to explain the bill. Senator Deuell sent up a
committee substitute; the chair recognized Senator Shapiro to
explain the difference between the committee substitute and the
bill as filed. Senator Deuell moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
testifying and registering on the bill are shown on the attached
list.
The chair laid out SB 574 due to testimony being the same for SB
848 & SB 574. The chair laid out SB 574 and recognized the
author, Senator Armbrister, to explain the bill. Testimony
continued for both bills and witnesses testifying and
registering on the bills are shown on the attached list.
Senator Madla moved that the committee stand recessed until 1:30
pm or upon adjournment of the Senate; without objection, it was
so ordered.
At 2:27 p.m. the committee reconvened.
The chair laid out SB 748 and recognized Senator Armbrister, in
the absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Madla moved that
SB 748 be left pending to await a quorum; without objection, it
was so ordered. Upon arrival of a quorum, Senator Gallegos, Jr.
moved that SB 748 be reported favorably to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 5 ayes, 0 nay, 0 present not
voting, and 0 absent. Senator Gallegos, Jr. moved that the bill
be recommended for placement on the Local & Uncontested
Calendar; without objection, it was so ordered.

Senator Lindsay, to explain the bill. Witnesses registering on

assumed the chair. Senator Madla resumed the chair. The chair
temporarily tabled SB 848 & SB 574.
The chair laid out SB 343 and recognized the author, Senator
Brimer, to explain the bill. Senator Brimer sent up a committee
substitute; the chair recognized Senator Brimer to explain the
difference between the committee substitute and the bill as
filed. Senator Brimer moved adoption of the committee
substitute; without objection, it was so ordered. Witnesses
registering on the bill are shown on the attached list. The
chair moved that the public testimony be closed; without
objection, it was so ordered. Senator Gallegos, Jr. sent up
Committee Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Brimer requested unanimous
consent to roll the amendment into the committee substitute;
without objection, it was so ordered. Senator Brimer then moved
that the new committee substitute be adopted; without objection,
it was so ordered. Senator Brimer moved that SB 343 do not pass
but that CSSB 343 be reported back to the Senate with the
recommendation that it do pass and be printed. The motion
carried with a record vote of 4 ayes, 0 nay, 0 present not
voting, and 1 absent.
The chair laid out SB 736 and recognized the author, Senator
Brimer, to explain the bill. Senator Brimer sent up a committee
substitute; the chair recognized Senator Brimer to explain the
difference between the committee substitute and the bill as
filed. Senator Brimer moved adoption of the committee
substitute; without objection, it was so ordered. Senator
Brimer sent
up Committee Amendment 1 and moved adoption; without objection,
the amendment was adopted. Witnesses registering on the bill

Senator Brimer requested unanimous consent to roll the amendment

429, and SB 748; without objection, it was so ordered. Senator
Gallegos, Jr. requested to be shown voting aye on SB 706;
without objection, it was so ordered. Senator Brimer requested
to be shown voting aye on SB 993, SB 748, SB 428, and SB 429;
without objection, it was so ordered.

The chair laid out SB 1104 and recognized the author, Senator
Madla, to explain the bill. There were no witnesses for this
bill. At the request of the author SB 1104 will be left
pending; without objection, it was so ordered.
The chair laid out SB 829 and recognized Senator Madla, in the
absence of the author, to explain the bill. Witnesses
testifying and registering on the bill are shown on the attached
list. The chair moved that the public testimony be closed;
without objection, it was so ordered. Senator Deuell sent up
Committee Amendment 1 and moved adoption; without objection, the
amendment was adopted. Senator Madla moved that SB 829, as
amended, be reported back to the Senate with the recommendation
that it do pass and be printed. The motion carried with a
record vote of 5 ayes, 0 nay, 0 present not voting, and 0
absent. Senator Madla moved that the bill be recommended for
placement on the Local & Uncontested Calendar; without
objection, it was so ordered.

moved that the Committee stand recessed subject to the call of
