         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Emerging Technologies & Economic Development was held on Monday,  
         April 18, 2005, in the Capitol Extension, Room E1.028, at  
         Austin, Texas.

         Chairman Carona called the meeting to order at 3:32 p.m.  The  
         Committee is in recess, and a quorum was established at an  
         earlier meeting and will be re-established as the meeting  
         progresses. 
          
         At 3:32 p.m. Senator Averitt assumed the chair.   
          
         Senator Averitt laid out HB 2307 and recognized Senator Carona,  
         in the absence of the Senate sponsor, to explain the bill.  
         Witnesses testifying and registering on the bill are shown on  
         the attached list.  The Chair moved that the public testimony be  
         closed; without objection, it was so ordered.  Senator Carona  
         moved that HB 2307 be left pending; without objection, it was so  
         ordered.     
          
         At 3:34 p.m. Senator Carona resumed the chair.   
          
         Chairman Carona laid out SB 1711 and recognized the author,  
         Senator Staples, to explain the bill.  Senator Averitt sent up a  
         committee substitute; Chairman Carona recognized Senator Staples  
         to explain the difference between the committee substitute and  
         the bill as filed.  Witnesses testifying and registering on the  
         bill are shown on the attached list.  The Chair moved that the  
         public testimony be closed; without objection, it was so  
         ordered.  Chairman Carona moved that SB 1711 be left pending;  
         without objection, it was so ordered.   
          
         There being a quorum present, the Clerk called role. 
  
         Senator Averitt moved adoption of the minutes from the previous  
         hearings held on April 4, 2005, and April 5, 2005; without  
         objection, it was so ordered.   
          
         Chairman Carona laid out SB 559 and recognized the author,  
         Senator Brimer, to explain the bill.  Senator Brimer sent up a  
         committee substitute; the Chair recognized Senator Brimer to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The Chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Chairman Carona moved that SB 559 be left pending; without  
         objection, it was so ordered.  
          
         Chairman Carona laid out SB 1254 and recognized the author,  
         Senator Brimer, to explain the bill.  Senator Brimer sent up a  
         committee substitute; the Chair recognized Senator Brimer to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The Chair moved that the public

         Chairman Carona laid out SB 105 and recognized the author,  
         Senator Shapleigh, to explain the bill. Witnesses testifying and

         Chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Chairman Carona moved that SB 105  
         be left pending; without objection, it was so ordered.      
          
         Chairman Carona laid out SB 277 and recognized Senator  
         Shapleigh, in the absence of the author, to explain the bill.   
         Senator Estes sent up a committee substitute; the Chair  
         recognized Senator Shapleigh to explain the difference between  
         the committee substitute and the bill as filed.  Senator Estes  
         moved adoption of the committee substitute; without objection,  
         it was so ordered.  Chairman Carona moved that SB 277 be left  
         pending; without objection, it was so ordered.   
           
         Chairman Carona laid out SB 638 and recognized the author,  
         Senator Barrientos, to explain the bill.  Witnesses testifying  
         and registering on the bill are shown on the attached list.  The  
         Chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Chairman Carona moved that SB 638  
         be left pending; without objection, it was so ordered.   
          
         At 4:44 p.m. Senator Brimer assumed the chair.   
          
         Senator Brimer  laid out SB 1038 and recognized Senator Carona,  
         in the absence of the author, to explain the bill.  Senator  
         Carona sent up a committee substitute; the chair recognized  
         Senator Carona to explain the difference between the committee  
         substitute and the bill as filed.  Senator Estes moved adoption  
         of the committee substitute; without objection, it was so  
         ordered.  Witnesses testifying and registering on the bill are  
         shown on the attached list.  The Chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Senator Carona moved that SB 1038 be left pending; without  
         objection, it was so ordered.    
          
         Senator Brimer laid out SB 1109 and recognized Senator Carona,  
         in the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The Chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Senator Carona moved that  
         SB 1109 be left pending; without objection, it was so ordered.   
          
         At 4:50 p.m. Senator Carona resumed the chair.   
          
         There being no further business, at 4:51 p.m. Chairman Carona  
         moved that the Committee stand recessed subject to the call of
