         Pursuant to a notice posted in accordance with Senate Rule  
         11.18, a public hearing of the Standing Senate Subcommittee on  
         Emerging Technologies & Economic Development was held on Monday,  
         April 11, 2005, in the Capitol Extension, Room E1.028, at  
         Austin, Texas.

         The chair called the meeting to order at 3:58 p.m.  The  
         Committee is in recess and a quorum was established at an  
         earlier meeting and will be re-established as the meeting  
         progresses. 
          
         The Chairman laid out SB 1100 and recognized the author, Senator  
         Deuell, to explain the bill.  Senator Brimer sent up Committee  
         Amendment 1. Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Chairman Carona moved that SB 1100 be left pending; without  
         objection, it was so ordered. 
          
         The Chairman laid out SB 1764 and recognized the author, Senator  
         Gallegos, Jr., to explain the bill.  Senator Brimer sent up a  
         committee substitute; the chair recognized Senator Gallegos to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.     
         Chairman Carona moved that SB 1764 be left pending; without  
         objection, it was so ordered.   
          
         The Chairman laid out SB 1304 and recognized the author, Senator  
         Seliger, to explain the bill.  Senator Brimer sent up a  
  
         committee substitute; the chair recognized Senator Seliger to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Chairman Carona moved that SB 1304 be left pending; without  
         objection, it was so ordered.   
          
         The Chairman laid out SB 937 and recognized the author, Senator  
         West, to explain the bill.  Witnesses testifying and registering  
         on the bill are shown on the attached list.  The chair moved  
         that the public testimony be closed; without objection, it was  
         so ordered.  Chairman Carona moved that SB 937 be left pending;  
         without objection, it was so ordered.   
          
         The Chairman laid out SB 1639 and recognized Senator Brimer, in  
         the absence of the author, to explain the bill.  Witnesses  
         testifying and registering on the bill are shown on the attached  
         list.  The chair moved that the public testimony be closed;  
         without objection, it was so ordered.  Chairman Carona moved  
         that SB 1639 be left pending; without objection, it was so  
         ordered.  
          
         There being a quorum present, the Clerk called role. 
          
         Senator Lucio, Jr. moved adoption of the minutes from the  
         previous hearings held on April 4, 2005, and April 5, 2005;  
         without objection, it was so ordered.   
          
         The Chairman laid out SB 1412 and recognized the author, Senator  
         Lucio, Jr., to explain the bill.  Senator Brimer sent up a  
         committee substitute; the chair recognized Senator Lucio, Jr. to  
         explain the difference between the committee substitute and the  
         bill as filed.  Witnesses testifying and registering on the bill  
         are shown on the attached list.  The chair moved that the public  
         testimony be closed; without objection, it was so ordered.   
         Chairman Carona moved that SB 1412 be left pending; without  
         objection, it was so ordered.   
          
         The Chairman recalled SB 1100.  Senator Brimer moved for  
         adoption of Committee Amendment 1; without objection, the  
         amendment was adopted. Senator Brimer requested unanimous  
         consent to roll the amendment into a committee substitute;  
         without objection, it was so ordered.  Senator Brimer then moved  
         that the committee substitute be adopted; without objection, it  
         was so ordered.  Senator Brimer moved that SB 1100 do not pass  
         but that CSSB 1100 be reported favorable to the full Committee  
         on Business and Commerce with the recommendation that it do pass  
         and be printed.  The motion carried with a record vote of 3  
         ayes, 0 nay, 0 present not voting, and 2 absent.    
          
         The Chairman recalled SB 1764.  Senator Lucio moved for adoption  
         of  committee substitute; without objection, it was so ordered.   
         Senator Lucio moved that SB 1764 do not pass but that CSSB 1764  
         be reported  favorable to the full Committee on Business and  
         Commerce with the recommendation that it do pass and be printed.   
         The motion carried with a record vote of 3 ayes, 0 nay, 0  
         present not voting, and 2 absent.   
          
         There being no further business, at 4:58 p.m. Senator Carona  
         moved that the Committee stand recessed subject to the call of  
         the chair.  Without objection, it was so ordered.
