         Pursuant to suspension of Senate Rule 11.10 and 11.18, a public  
         hearing of the Senate Committee on Business & Commerce was held  
         on Friday, May 12, 2006, in the Senate Chamber at Austin, Texas.

         Senator Kyle Janek, the acting chair, called the meeting to  
         order at 4:48 p.m.  There being a quorum present, the following  
         business was transacted:   
          
         The chair laid out HB 163 and recognized the sponsor, Senator   
         Williams, to explain the bill.  Senator Janek opened public  
         testimony. There were no witnesses registered on the bill.  The  
         chair moved that the public testimony be closed; without  
         objection, it was so ordered.  Senator Averitt moved that HB 163  
         be reported favorably to the Senate with the recommendation that  
         it do pass and be printed.  The motion carried with a record  
         vote of 5 ayes, 0 nay, 0 present not voting, and 4 absent.    
          
         There being no further business, at 4:51 p.m. Senator Janek  
         moved that the Committee stand recessed until call of the  
         chairman. Without objection, it was so ordered.
