         Pursuant to suspension of Senate Rules 11.10 and 11.18, a public  
         hearing of the Senate Committee on Business & Commerce was held  
         on Wednesday, June 29, 2005, in the Senate Chamber at Austin,  
         Texas.

         The chair called the meeting to order at 1:20 p.m.  There being  
         a quorum present, the following business was transacted:   
          
         Chairman Fraser laid out the Committee Rules which were  
         previously provided to the members for their review.  Senator  
         Armbrister moved adoption of the Committee Rules.  Without  
         objection, it was so ordered.  
          
         The chair laid out SB 40, pending in committee, and explained  
         the committee substitute in the absence of the author.  The  
         committee substitute had been sent up at a previous hearing.   
         Senator Armbrister moved adoption of the committee substitute;  
         without objection, it was so ordered.  Senator Armbrister then  
         moved that SB 40 do not pass but that CSSB 40 be reported back  
         to the Senate with the recommendation that it do pass and be  
         printed.  The motion carried with a record vote of 5 ayes, 0  
         nay, 0 present not voting, and 4 absent. 
          
         Senator Armbrister assumed the chair.   
          
         The chair laid out SB 20, pending in committee, and recognized  
         the author, Senator Fraser, to explain the bill.  Senator Fraser  
         moved that SB 20 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 4 absent.   
          
         The chair laid out SB 21, pending in committee, and recognized  
         the author, Senator Fraser, to explain the bill.  Senator Fraser  
         moved that SB 21 be reported favorably to the Senate with the  
         recommendation that it do pass and be printed.  The motion  
         carried with a record vote of 5 ayes, 0 nay, 0 present not  
         voting, and 4 absent.   
          
         Senator Fraser resumed the chair.   
          
         The posting rules, Senate Rule 11. 10 and 11.18, were suspended  
         to hear the following pending bills:  
          
         SB 20 
         SB 21  
         SB 40 
          
         There being no further business, at 1:25 p.m. Chairman Fraser  
         moved that the Committee stand recesses subject to the call of  
         the chairman.  Without objection, it was so ordered.
