         Pursuant to a notice posted on February 18, 2005, the House  
         Committee on General Investigating & Ethics met in a formal  
         meeting and was called to order by the chair, Representative  
         Bailey, at 8:08 a.m. 
          
         The roll was answered as follows: 
          
         Present:   Representatives Bailey; Paxton; Dutton; Flynn; Keel  
                    (5). 
          
         Absent:    None (0). 
          
         A quorum was present. 
          
         Chairman Bailey advised the committee of the actions taken in  
         regards to Jason Cooke and how long we have attempted to obtain  
         answers to questions concerning the HHSC and CHIP Rural  
         contract. Our last attempt was by letter to Jason Cooke's  
         attorney of record, with no response. 
          
         Chairman Bailey advised the Committee he would accept a motion  
         to authorize a subpoena to compel Jason Cooke to appear before  
         the Committee and testify. 
          
         Motion to authorize a subpoena was made by Representative Dutton  
         and duly seconded by Representative Flynn. 
          
         The motion prevailed by the following record vote:  
          
         Ayes:           Representatives Bailey; Paxton; Dutton; Flynn;  
                         Keel (5). 
          
         Nays:           None (0). 
          
         Present, Not Voting:     None  (0). 
          
         Absent:         None  (0). 
          
         At 8:15 a.m., on the motion of the chair and without objection,  
         the meeting was adjourned subject to the call of the chair.
