LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 79TH LEGISLATIVE REGULAR SESSION

March 21, 2005

TO:
Honorable Kent Grusendorf, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Deputy Director, Legislative Budget Board

IN RE:
HB283 by Hope (Relating to the transfer of public school students who are the victims of bullying.), As Introduced

No fiscal implication to the State is anticipated.

The bill would add Section 25.0341 to Chapter 25 of the Texas Education Code.  The proposed section would require a school district to transfer a student victim of bullying to another classroom or campus upon parental request.  The bill would require the board of trustees to verify that a student has been a victim of bullying before transferring the student.

Local Government Impact

School districts would likely incur some administrative costs associated with processing transfer requests and documenting verification that bullying occurred.  However, because many districts already have well-established procedures for reassigning students from one classroom or campus to another, it is assumed that there would be no significant fiscal implication to districts.
